Help with Virgin Claim going to Court

Look at the NEWBIES FAQ thread in the Parking board, post #2. This covers the court stage. Yes, it's geared around parking companies taking people to court, but it outlines the process and what the various stages are so it should still be useful.0

Thanks for the update. I really cant believe they are still messing you around for a grand. Their complacency also sounds extremely frustrating (but all too believable!)0

Much appreciated guys.
@Waamo - Yes, I've already created a statement or one with many bullet points explaining what had happened and when - The photos/videos are ready to go and will be added to this once I definitely know that we're not going to get this resolved.
@DoaM - Thanks mate. I'll take a look at it.
@Wesleyad - Yeah...they're just taking the mickey. Making stupid excuses that they never received anything, even though I've got proof of postage and written letters from them confirming receipt!0 -
Brilliant. As I said a while ago much of this will be about being organised. Send that bundle to them. You will, at some point, need to send it to the court too.0

Mate, I sent the whole bundle to them including a cd with all photos/videos in sept last year via recorded-delivery - they even confirmed receipt in a reply a week later...The defense though, say has not been received nor did they have any further info regarding my past contact with them....It's just ridiculous. Also I was advised by the mediator that the vm defense team had hinted they would be in touch with me as they didn't feel they had enough evidence to make substantial offers. As soon as I receive any correspondence, I will send it again.0 -
Don't refer to it as 'recorded delivery' as I believe that service was replaced with 'signed for' a number of years ago.0
-
Take a belt and braces approach. Send it directly to the defence team. First class not signed for. Just get a receipt from the post office.0
-
Rainbowgirl - Sure, I'll try and remember it,
waamo - You mean send it even before any correspondence is received from them?0 -
The court process will state when each party is required to file their evidence. (Your evidence to support your claim; their evidence to support their defence). You can't just wait for them to file so you can amend your evidence - they could take the exact same approach.
It's at Witness Statement time when you can clarify what your evidence means and also rebut elements of their evidence.0 -
If you have all your evidence and are ready to go I see no point in sitting around waiting for something to happen.
They get to see it anyway so they might as well see it sooner rather than later.0
