This is very much battle of the organised now. Sadly I can't read the evidence it blows up badly on my screen but if it's well organised it should be good.

ivan - Yeah, ridiculous isn't it?

waamo - I've recreated some of the files again into pdf documents. Here is the link:

I would be grateful if you or anyone else could tell me:-

1.Does the witness statement wording make sense? Do I need to edit or add more?
    2. Does the timeline page make sense? Or does the content need to be merged with the witness statement?
    3. Is the photo/videos pdf need any references to each photo/video?
    4. Is the labelling of the files as A, B, C or A1, A2, B1, B2 make sense?

    Thanks ever so much!
  • I don't suppose anyone has had the chance to check out the pdf docs for me?

I would be very grateful if you could help me.

I just want to make sure they are in the correct format and make sense before I email everything.

I'm on my phone for the next few days. It doesn't look clear on that. I won't be back on a decent laptop till after the weekend sorry.

What I will say is the timeline is actually part of the witness statement so treat it as thus.

Thanks Waamo... I just don't know how to merge the two into a single document so it all makes sense.

I'm just wondering whether I should hold off for a week or so to sort out this paperwork in a perfect and chronological way. It's going via email, so will be with them instantl, so worst case scenario, even if it got to them by 10th Feb, that would be more than enough time for them to dwell over the paperwork.

It doesn't have to be perfect for the defence team to look over. This is purely so they can decide if they want to settle at the moment.

It will need to be perfect when it goes to the court. With that in mind I would say it's ok to send to the defence as it is but can he honed ready for final submission.
  • That's exactly what I was thinking too. After all the defence team have made an informal contact to ask for more proof. So I'm going to hold sending documents that the courts will ask me at a later date to send anyway. Instead I'm thinking of forwarding them only a document with photos and links to the videos and the damage estimate. Does that sound okay to you?

Sounds too to me. As I said this is purely to see if they will settle before a hearing. Hopefully they will see you are well prepared and decide to avoid a potentially expensive hearing.
  • That's really helpful Waamo. I'll get as much as possible prepared. Will let you know how I get on.

    Thanks to everyone again
  • Hi again guys.

I have some bad news...I won't go into detail of everything, but the VM solicitors sent out one of the contractors to inspect the damage. However upon arriving almost immediately, he was in denial of the damage. I said to him that he needs to be professional and not take sides. He said that although he could see the damage, he didn't feel it was totally the fault of the installers. It became a heated argument as he wasn't willing to accept my version of events at all and eventually he walked off.

Before they visited my property, I did make it very clear to the solicitor via email that I would like a person to attend who is non-biased and has no conflict of interest, but she insisted that it can only be done by this person due to them being in charge of the area.
