Help with Virgin Claim going to Court

  • Thanks Waamo. I did see this form, but I'm not sure how to complete it as it says the judge also needs to sign it (i think).

    Also:

    1. Can I send it via email to all parties?
    2. Will I be charged by the courts for this?

    I would send it by post. It's absolutely free. No fee for discontinuing. It's what the court wants to happen after all.

    Email a copy just so everybody knows. I like a belt and braces approach.

    Cross out the the first ‘defendant’ in brackets. Tick the first box and cross out the word ‘counterclaim’.

    Then cross out ‘following defendants’, ‘claimant’, and ‘following claimants’.

    Then cross out everything in the brackets which starts and ends with the full stops (certain types of cases require the courts permission to discontinue, this isn’t applicable here). Then sign and date it.

    Also remember to fill in the boxes at the top right.

    There’s no fee.

    You need to file it at the court that the matter has now been transferred to for the hearing. I would suggest post, or if it’s local, hand delivery. You can serve it on VM by email if they agree to accept service by email, if not it’ll have to be posted.

  • Good morning everyone.

    Just to help others.... after speaking with the County Court admin person, I didn't need to complete any forms. All she said was that I needed to send a short email stating that I would like to discontinue any court action, whilst cc'ing the defendant too. Within minutes of sending this, the courts and defendant issued an email stating it had been noted on record and no further action was required.
