Hello again guys. Hope you had a wonderful xmas. I know I went quiet on the thread for a while (1 month precisely, lol!), but that was because the thread was getting too long and you guys had already helped me with all my questions. I've now received an offer of mediation middle of jan 2019 and accepted it.
As you can imagine after all this, I just want to get this over and done with.
I've already been told that no evidence will be needed during the mediation and it's simply going to be a matter of the mediator passing the message on to each party until we reach an agreement. If no agreement is reached by the end of 1hr, then case goes to court.
However I want to be prepared as best as I can, so any tips would be really appreciated on what I should have ready and what or how I should fight my corner.0 -

You won't need to "fight your corner". Everything will go through a mediator.
The only advice I can give is be prepared to be flexible. In saying that don't accept an offer you aren't happy with. This case should be ideal for mediation as long as both sides are prepared to show some flexibility.0 -
For mediation you need to be prepared with two things:
- Be prepared to concisely and clearly explain what your case is about. You should be able to explain why you have a compelling claim in a couple of sentences at most. You need to be able to clearly explain your claim to the mediator so that they can explain it to VM's representative.
- Decide in advance what you would be prepared to accept in a settlement offer. Have a minimum figure in mind.0 -

Hi Guys,
Just a quick update about mediation today...it's sadly been unsuccessful due to:
1. VM defence stating that they had little evidence from me with regards to any damage...They didn't even know that I had not only sent an email with dropbox links of evidence to their CEO Tom Mockridge, but that I had also sent a recorded-delivery letter with a CD full of photos and videos etc. I told the mediator that it's upto VM defence to make sure they've checked that their paper trail as clearly they don't even know what's going on.
2. Due to their excuse on point 1, they only offered me reimbursement of court fees.
I gave the recorded delivery reference to the mediator to pass to the defendant as my proof of postage of the CD and LBCA. The defendant is now saying that she will look into this and be in touch with me out of court. Until then, I've got to wait for a court date.0 -
Shame. I would also send all your evidence of damage to the defence team so they have it too. I hope you put it in your witness statement?
Looks like you now have to pay the hearing fee.0 -
I'm waiting for the vm defence team to contact me and then I'll send everything again. I don't mind paying for the £60 court fees, although I'm concerned whether there will be any point in all this headache.
What witness statement are you referring to mate?0 -
Back in post 116 you were told to start work on a witness statement. Essentially something laying out precisely what has happened with evidence such as photos.
You need that now.0
