  • So I have been secretly hoping that the court claim wouldn't come through a it has taken so long, but it did.

    I have been reading through the second post of the newbies thread for guidance.

    My question is; considering my husband received over 10 of these tickets, how can he claim poor signage etc? He obviously knew after receiving the first ticket that there were parking restrictions but continued to park as he was a resident. He was promised by the "landlord" that he would "sort out" these tickets and get the charges removed. But the "landlord" was illegally sub letting and he is now in jail. Does my husband have any grounds to defend the tickets?

    So you now have a Claim Form from the County Court Business Centre in Northampton. Is that right? Or has it come from somewhere else?

    What is the Issue Date on the Claim Form?
  • Yes received claim form from county court bus centre in Northampton.

    It is for only 3 of the tickets and not all the outstanding tickets, as we did request for them all to consolidated on to one claim in the letter before (not sure if you had a chance to read through my thread).

    With a Claim Issue Date of 10th December, you have until Monday 31st December to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL].

    Having done the AoS, you then have until 4pm on Monday 14th January 2019 to file your Defence.

    That's four weeks away. Loads of time to produce a perfect Defence, but don't leave it to the very last minute.


    When you are happy with the content, your Defence should be filed via email as suggested here:
      Print your Defence.
    1. Sign it and date it.
    2. Scan the signed document back in and save it as a pdf.
    3. Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    4. Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    5. Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    6. Do not be surprised to receive a copy of the Claimant's Directions Questionnaire, they are just trying to put you under pressure.
    7. Wait for your DQ from the CCBC, or download one from the internet, and then re-read post #2 of [URL="https://forums.moneysavingexpert.com/discussion/4816822NEWBIES FAQ sticky thread[/URL] to find out exactly what to do with it.

    Of course, where I say 'you' and 'your' I mean the Defendant.
  • I done the AoS on the 18th December online as advised.

    So now with Christmas/New Year and kids out the way it's time to prepare the defence, do I just prepare a defence based on the my post of this thread? If not, could you point me in the right direction.
