Yes, but working busily at school as well and not planning to stay up quite so late as I did in 2018, posting here.

ok, I've read through NEWBIES FAQ sticky, post #2 and paid particular attention to the inputs by bargepole.
I am confused, how can my husband claim poor signage when he received multiple tickets? The first ticket obviously alerted him to the parking restrictions and he was actually fully aware before, but was told by a dodgey landlord that the tickets would be cancelled and that he would get him a permit.
The defence example I found, under point 2. states having a valid permit to park, but he didn't, do I just omit this point?
Many thanks for your continued help and guidance with this0 -

Same old, same old in the main. A small number where RK lives in Scotland, ticketed in England (and vice versa), which adds a bit of interest (not a lot!).
But I wonder if you saw these:

I've been back through 250 of my inputs since Christmas Day, and that's about the lot in terms of anything 'different' from the usual Groundhog Day stuff.
You've been much missed, but you've not missed much!
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Ooh, I didn't see any of those threads, even though I read the forum occasionally. Thanks Umkomaas.
Yes and no. Change it.The defence example I found, under point 2. states having a valid permit to park, but he didn't, do I just omit this point?
Search the forum for defence Pace v Lengyel, which is mentioned on threads like yours an is a case with a decent Judge's decision where the person cannot have been 'authorised' as they didn't have a permit, but they won their case.
When I say search, I mean read the defences on 'no permit' threads like yours that'll come up when you do that search, this board only (tick: show POSTS, not 'threads'). You will also no doubt find a link to the PACE v Lengyel transcript, hosted by the Parking Prankster, and you should read that transcript, to see what I mean.
Also use it (at Witness Statement & evidence stage) to support the Defendant's case.
Where is your local court?
PACE v Lengyel was by a Manchester Judge & they are good at sussing the 'outrageous scam' (Hansard) operated by PPCs, and Defendants win, more often than not.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We are based near Dartford in Kent.
I have been searching and reading for 2 evenings but I'm struggling to find the exact info on threads/posts that you have mentioned above.
Lots of threads that mention the said PACE v Lengyel transript but I haven't been able to find the actual link yet.
I must be using the search function incorrectly.0 -
Hi missyjingles
Sometimes when the regulars mention searching for examples it may not always be forum limited. If you google Pace vs Lengyel you will readily find a transcript from a blog by the parking prankster.
In any case here it is below:

Is there an example defence in layman terms that I will be able to understand with regards to my husband's situation?
I'm struggling to understand the basis for his defence.0 -

There are several example defences in NEWBIE sticky post #2 written by Bargepole, adapt one of those.
Only you and he know the basis for your defence, you can see the POC sent to you by the PPC. Your defence needs to challenge each and every claim they put forward with a legal/technical reason why it is not true. For example "You failed to purchase a ticket in a PDT car park" Your defence is "I/my husband/the DRIVER did buy a ticket and I have already sent a scan of that ticket to the PPC" You then keep a copy of the ticket to use at WS and evidence stage.missyjingles wrote: »I'm struggling to understand the basis for his defence.0 -
Thank you all for your continued help, but I have no clue what I'm doing. I've read the newbies thread and looked for a defence example close to mine but could not find one.
Husband temporarily moved out due to marital problems and moved into a room in a house share. No contract, all cash, although he does have a piece of paper with a signature for the first months rent and deposit. The room included off street parking, but he was never given a permit and racked up 10 tickets.
After 2 and a half months living at the property, an eviction notice was served as the “landlord” was not the landlord, he was illegally sub-letting the rooms in the house, hence no parking permits ever given to the tenants.
Is this his defence?0 -

For your own sake, you are overthinking it. Get on with the defence...
No, but the facts are relevant to be briefly stated within the defence that will be based on the usual bargepole versions.Husband temporarily moved out due to marital problems and moved into a room in a house share. Like here...please can people just write a defence like this, just copy & adapt, it is simple:
