Fifth Anniversary Combo Breaker
edited 29 August 2018 at 4:51PM in Parking tickets, fines & parking
Our situation as briefly as poss;

Husband temporarily moved out due to marital problems (thankfully all sorted now) and moved into a room in a house share.

The “landlord” took deposit and rent monthly.

Husband got first ticket parked outside from PCM, he spoke to landlord who assured him nothing would come of it. After receiving 3 tickets, husband pressed the “landlord” again who said he had requested an additional parking permit for him. Husband spoke to adjoining neighbours as everyone regularly had these tickets. All said nothing would come of them.

After 2 and a half months living at the property, an eviction notice was served as the “landlord” was not the landlord, he was illegally sub-letting the rooms in the house, 4 bedrooms. He pocketed everyone's deposits and rent for approx 4-6 months and did not forward any rent on to the actual landlord. He is now in prison for other charges. My husband lost his deposit and had to move out before the end of the month.

My husband never told me about the tickets, he didn't want to worry me.

So here we are, he received approx 10 of these tickets, I'm in the process of finding out exactly how many there are.

I honestly just don't know where to start with all this.

It looks like one of the tickets has already gone to court, which was when we were away on holiday and a judgement against my husband was made £440.

I have tried reading through all the advice here but I am struggling to absorb the info.

My stress levels are through the roof at the prospect of how much the remaining tickets could add up to.

I would be eternally grateful to any advice.

Give us some paragraphing please to make the wall of text readable.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Could be argued that your husband was an inadvertent trespasser then, and relied in good faith on a contract with someone who was 'offering him Buckingham Palace' even though it wasn't theirs (see how the PPCs argue that on, not joking!).

How on earth did he not reply to a Court Claim form?

Does he have any other Court claim forms?

Post #2 of the NEWBIES thread is not hard to follow, and is all you need.

There might be grounds to get the first judgement set aside. We need details of what happened and when though in order to advise.

Does a CCJ matter to him?

If he paid it off tomorrow there would be no CCJ.

If he tries to get it set aside it will take longer, and does he have grounds? Was he away and never saw the Claim form? Or did he ignore it then go on holiday?

I am reading through it all just now, I don't why he didn't reply to court claim, head in the sand comes to mind.

Yes many other letters, just sorting through them all now, no other court claims, but many letters before claim.

We were away for 4 weeks, husband is greek and we stay with family during the school summer holiday.

He saw the letter before we left for holiday.

Then he doesn't have a case to set it aside. He has been ''done'' for that one and must pay it within 30 days of judgment to avoid mucking up his credit rating. What a mess.

What about the others, any claims to acknowledge online today?
