    Never too late to file a decent WS and evidence and hope the Judge allows it. You know about that stage because it's explained in the NEWBIES thread too, under the example defences that you appear to have missed.

    Is it The Keeper or The Driver who is being taken to court? It can't be both. I think from your subsequent posts it is The Keeper, but can you please confirm.

  • I have just spoken to the court who have stated that their is a defence they need us to return the DQ questionnaire? They have said that any evidence in which we want to disclose can be sent along with the DQ?

    Why are you asking these questions of us?

    You know your Dad put *some random words* in on MCOL (OUCH!), and that is the 'defence'.

    Did you not ask for those words to be emailed to him? You need to know what the defence said but it is NOT for you to ask. How the heck did you speak to them if YOU are not the Defendant? You are a stranger to it and they should not have said anything, this is your Dad as Defendant, isn't it?

    Or are you the Defendant and your Dad put words in online, without your consent?

    I am trying to help my dad (the keeper) for which is my error (the driver) i have spoken to the court as he has given me permission over the phone to speak on his behalf. He stated simply on the MCOL that i was the driver of the vehicle at the time and that he was the keeper of the vehicle.

    He also stated on the MCOL that he was currently in contact with Gladstones.

    yes i understand it is a mess, i was trying to follow your advice on here but he panicked (being old) thinking he was doing the right thing but i realise he has made a mistake i am just trying to rectify a now nightmare situation. which looks nearly impossible.

    i wasnt aware that he had done this but now i am up !!!! creek without a paddle to say the least :(

    You know not to do Mediation. NEWBIES thread tells you that.

    You know about WS and evidence stage. NEWBIES thread tells you about that too.

    You know this is your Dad's case not yours and you can't go to a hearing instead of him.
