  • If you've been asked to complete the N180 then you have defended the claim.


    Tell us exactly what you did, said and wrote after you received the Claim Form from the court.


    You wouldn't have just written "a letter". We wouldn't have advised you to do that either. When your receive a court claim you have to complete the Acknowledgment of Service to say you are defending, and then you have to file a Defence. All within strict time limits. If you fail to do one or other of those, judgment in default is entered against you. If you do what you're supposed to do, you get the DQ N180 to fill in. After that the case is transferred to your local court, you're told to do a WS and a hearing date is set.


    So you MUST have filed the AoS and a Defence!

  • If the court has sent you the N180 it will also have sent you a court order. Did you receive one?


    or has the N180 been sent to you by the Claimant?


    either way, something very amiss here which we need to sort out.

    What is the date on the Court claim, you have not answered.

    I am thinking he hasn't been sent an N180 by the court, just G's version, and hoping that in fact he has not defended and is still in time...

    ok i was parked in the rear car park to work my work and was issued with a debt collection letter through the door which was ignored. i then received other letters from Gladstones etc which i ignored.

    i then received a notice before claim letter which i responded to with the letter in which you advise on your other threads i did not hear back from them until i received a claim letter which i then responded to Gladstones with the letter again to state i had not received a response.

    I returned the letter with the original claim form.

    I have just spoken with my dad who said he has filled in a money claim form to state discussions where still being made with gladstones (my dad has told me he filled this in?) do i need to find out what he has done? he is old and has sent this in panic?)

  • The OP needs to phone the court and find out what steps have been taken in relation to the claim.
    Has an AoS been filed
    has a defence been filed


    The N180 is a red herring, it's been sent early by gladstones, which is what they always do.


    But Gladstones obviously think it's being defended.


    either it is, in which case with what????? or it isn't and you need to file one ASAP.


    You can't defend in your own name if the named defendant is your dad. It's too late to transfer liability to you as driver. He has to defend as RK and deny being the driver.


    If you have not filed anything there may still be time.


    Phone the court NOW. Find out what date the Claim was issued, and whether the Defendant has filed ANYTHING

    You need to phone THE COURT and find out EXACTLY what has been filed. This is extremely important.

    Whatever he put there, is the defence. OUCH, COMPLETE MESS.
