Passed Medical but DVLA Failed me

    What you mean? I am not on here to seek. Advice but more if anyone has been in the situation or known if this happen to anyone.
    The DVLA said I might have to pay for another medical and I am not paying something twice for them to fail me regardless.

    How would you like it if they want you to pay two lots of fees anf have no guarantee that they wi even give you a license?

    Like I said I am paying for the application fee but that's it. If they want me to do a medical then it has to be paid by them or I will the judge decide.

    It's simple don't pay for the medical and save yourself a few more quid by not applying for a licence.

    Thems the rules, if you don't like it don't drive.

    How much are they asking you to pay? If it's £500 I can perhaps see your reluctance to pay but if it's more like £100, is that really too much to pay to get your licence back?

    As others have said, if you wanted to appeal it you should have done it when they failed you. Now so much time has passed, even if you had passed that original medical and had the application denied for something else, the medical wouldn't mean anything now because so much time has passed. You just need to grit your teeth and do it! Or, if you only want it for ID (which you seem to suggest), get a passport instead.

    Actually I have contacted them a few times in the past years for information regarding my medical and they failed to send it to me, 3 tomes of asking!

    Solicitors said they failed and treated this case unfairly and has no ground to revoke my license.

    So if they ask me to pay for another medical I will refuse and take it to court. He said they more like drop the case because they have nothing to go on.

    Going to court with a solicitor will cost a lot more....

    Realistically there is no chance the DVLA will pay for your medical if you need one.

    Think about how it looks on your driving record...
    Somebody who got a ban for a high level of blood alcohol while driving, and who then failed a medical for getting their licence back.



    Is a medical really inappropriate in those circumstances?



    Surely, if you aren't a heavy drinker, the medical will be straightforward to pass?


    You say you're a scientist in the healthcare/medical industry - so you must understand the issues here...

    Even simpler. No medical = no consideration of your application. There is nothing for a judge to decide. You have no right to a licence. With your history, a medical is not unreasonable.

    When was your licence revoked? When you became a criminal the court took it off you. Looks like you've never had it back.

    You can't just take someone to court because you disagree. As has been said you will need to seek Judicial Review and you will need deep pockets for that.

    Why not issue a simple Subject Access Request asking for all the information the DVLA hold on you? The ICO can force them to release it if they dither around.

    I'm a HGV driver, I'm on 5 yearly medicals and some of the people I work with are on annual medicals. We all take the medical knowing that they may find something that results in us losing our license and with it our jobs. If we want to continue to do the job that's what we have to do because those are the rules.

    They won't pay so I guess you're not going to be driving again any time soon.

  • I paid £138 plus £90 application fee.

    I am not paying them another £135 (maybe more now) for them to still fail me if they wish too.

    Don't you get? Why pay or do a medical if they are ignore they results and still go a theory of "He could be a high risk" that's them making a judgement on me without any evidence.

    It not the money I am bothered about, its the fact how they handled this.

    I rather spend £500 in court than a penny more on them.
