Passed Medical but DVLA Failed me

    I did appeal back then but they never respond to me, only a refund for the application fee

    ....and you should probably have followed it up at the time.

    In my opinion there is absolutely no point trying to appeal a decision made nearly a decade ago!

    Reapply for your licence (again) and go from there.
  • Because they was t me to take it again which I don't mind doing a medical but I am paying for i because I passed their first one.

    Don't you get it? They want more money for something that I fairly passed, yet they made judgment on me and predict that I could do it again.

    The solicitors given me some good advice and said I shouldn't have to another medical because I have already passed and they unfairly revoked my licence and never respond to my letter of appeal and witheld my info.

    So I will pay £90 and apply but as I said I will not pay a penny more to them.

    And like we are saying.....it was 8 years ago, get over it. You didn't follow it up at the time so no point going on about it.

    Yeah yeah that what anyone would say but you was not in the situation that I was in and you can sit there and say "I wouldn't of done it" but you don't know that when have alcohol in you and a gang want to beat you up.

    Buf whatever kid make judgment but you weren't there.

    No, you aren't.

    Your judicial ban was 18mo. That expired in 2010.

    The block on regaining your licence now appears to be medical. Perhaps it was a mistake in 2010, perhaps it wasn't. But it sounds as if you've not done anything about it between 2010 and now - if that is the case, then that's not DVLA's problem, it's purely down to indolence on your part.


    If that's not the case, and you've been fighting an ongoing battle over that intervening time, then it seems you've forgotten to give any detail about that - but it'd be WAY above our paygrade here, anyway. That'd be one for your MP (who I'd assume you'd brought in long before now).
  • What you mean? I am not on here to seek. Advice but more if anyone has been in the situation or known if this happen to anyone.
    The DVLA said I might have to pay for another medical and I am not paying something twice for them to fail me regardless.

    How would you like it if they want you to pay two lots of fees anf have no guarantee that they wi even give you a license?

    Like I said I am paying for the application fee but that's it. If they want me to do a medical then it has to be paid by them or I will the judge decide.

    A judge can decide on what. What exactly are you going to take them to court for?

    Out of curiosity which court will you be applying to in order to force their hand? It's clearly beyond the remit of county court so would this be a Judicial Review?
  • Actually I have contacted them a few times in the past years for information regarding my medical and they failed to send it to me, 3 tomes of asking!

    Solicitors said they failed and treated this case unfairly and has no ground to revoke my license.

    So if they ask me to pay for another medical I will refuse and take it to court. He said they more like drop the case because they have nothing to go on.
  • The crown court I believe but the solicitor said they will more likely to drop it because the evidence they have is nothing but their own guidelines.
