Passed Medical but DVLA Failed me

Right here we go....

I was done for drink driving back in 2009, double over the limit....so in short I was banned for 18 month and the court said I can do a course to reduce the ban (which I did)

So as some of you know, if you are double over the limit you need to do a medical test......well I went to my Dr and said I would like a medical test from him before I do a DVLA medical test, to make sure I am fit and not alcohol dependent. Now at the time of the ban I was drinking at home a few more cans than normal because I lost my job and was depressed. However the Dr said I am showing mow sighs of alcohol dependence, my results came back clean and he said I am just depressed and should see a counseling because I wasn't a heavy drinker or anything.

So come to DVLA test, I went and he said I was looking good and he had no worries, the results came and I passed the DVLA medical test......BUT DVLA said I failed because of my "alcohol dependence or abuse"......they got this from my DR. Now I went to my Dr and showed the letter and he was angry and said he never said or advice them, all he said I was fit enough to drive and he had no corners, yet DVLA acting like there know better?! Yet their OWN chose of Dr had NO concerns and I passed their test!

This all happen in 2010....now it''s 2018 and they said I have to pay £90 for application fee, which is fine but they said I might have to do the medical AGAIN and PAY the medical test. I could do this again but they could easily fail me if they want.

Surely this is not right? I am planning to take this to court and fight for it because I need ID and I want this part o my life closed and not hanging over me.....it's bee 9 years since I done the drink driving, I feel like I have killed a person and being punished still!!

    Take what to court?

    I would suggest the easiest way to resolve your issue is to follow the correct process, do you currently have any personal problems that would prevent this?
  • No I am fit, always have been and have no problems, I worl k for Cancer Research as a Science Officer and get medical check up by work yearly.

    I have followed everything, that's the point here. I have been informed I can that this to Court because the judge can look into this because DVLA are NOT medical experts and the decision need to be backed with evidence that I am a risk.

    I have more evidence that I am fit and none danger to the road.

    If I read it right you applied for a licence and were refused 8 years ago, the time for appealing the decision was back then.

    For someone double the limit I'd take away their licence for life. You got off lightly.
    I used to think that good grammar is important, but now I know that good wine is importanter.

    He didn't get off lightly because you don't get to decide the punishment from your armchair.

    I have done my time, still being punish for after 9 years, so how do you work that one out?

    Make judgement on me for my actions if you wish but don't ever dare say you wouldn't do it because I never though I would drink and drive in my life. I only drive ghat night because I got into fight and fear for my life. Drove 300 yards and police stop me because they saw me running away from a gang, then they knew I was drunken and in distress.

    Yet I am still punished for it.

    You are going to have to forget what happened 8 years ago and now go through the due process and take it from there.

    Have to say I don't see what you are concerned about this time around.....unless you are still a heavy drinker?
