It's a newish estate, one of those I believe are kept by the residents rather than the council. There's a couple of hundred houses there I guess so pretty big. It's no parking bays, no yellow lines, Just signs to say no parking as the residents don't want people parking in the road. They all have one driveway space each. If you assumed it, what did the signs actually say. Have you requested pics of the signs and the paperwork yet?
It tends to help if you can
a) See what they claim on the paperwork
b) refer it to the wording on the signs
c) relate that to the actual space** the vehicle was parked in and
d) whether the signs could have been seen by the driver.
Also always helps to start with the facts.
**Lease will be useful if the vehicle was parked on space controlled by the client. Less so if it was communal areas OR someone else's space.0 -
Places like Pulse in north London use UKCPM and the signs tend to be small and sporadic so if you can video your approach to the parking space - and what signs were close by - then it would help the court to decide if the breach was inadvertent or not.
The £100 is payable by those who flout the known, clearly expressed and detailed rules. Parking companies may wave a sign a people, but people have to be able to read and understand them.
Pics of any markings on the road would be useful too. There is the argument that you compare with statutory road markings which means double yellows as that is a recognised context. There surely must be something in the lease about parking for contractors/delivery etc. You could tell the people that you are working for that their estimate has suddenly increased by the amount of your parking charges as you had not factored this into the estimate.
The Inland Revenue will be well pleased if contractors are claiming parking charges as a business expense. You have to park in order to complete the work in which case the cost of parking is the parking charge which is an expense.

Ok I went back there this afternoon and it actually turns out there are no signs whatsoever. No yellow lines and no parking bays. If i remember rightly. The home owners told us we weren't allowed to park there as all the residents come together to put this parking charges in place. I've taken photos so I can upload them if that helps?0

Unless they are photos of any actual signage (and its contents), there's nothing we can say other than 'there doesn't appear to be any signage there'. Save them for any court case, so a Judge can determine what contractual obligation the driver had to the PPC.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

If they did not take people to court they would not be able to pull off the scam. They know that they will lose some cases at court. Sometimes they play brinkmanship. They could bail on you at the last minute.

Well. I'll get a defence written up tonight. I'm hoping with a defence claiming there's absolutely no information to tell anyone no parking, they don't have a leg to stand on0
