unlawful parking ticket received from UKPC in ASDA

Hi all,
Back in may I parked in a disabled bay in Asda's car park displaying my blue badge as usual, to my surprise when I came back I found a ticket from UKPC telling me that I have not displayed a blue badge, the attendant then took the picture in a squatting position making sure the badge was not visible on the photo.
I was so frustrated and went looking for the attendant to smash his face but couldn't find him, anyway went straight home and done the appeal giving a false address but my real name and clicked to receive the answer via email, the surprise is that the answer to my appeal was never sent to my email as requested, after a while remembered that I should have received an answer I went back on their website to check if they cancelled my ticket, unfortunately it wasn't and found that the charge has gone up to £160.
Tried calling them to no avail, no one answered my call after 45 min wait.

I am not sure what to do now? shall I ignore them or complain and give them correct address and ask for rejection code to complain to POPLA or what?

Please help

Thanks

LOL, why the heck of hecks did you try to phone a firm like UKPC? STOP!!!

Did you miss the fact UKPC were banned from getting DVLA data in March - May? What date was that parking event? You should have ignored it if it was in the ban dates.

The good thing is they can NEVER get your address if it was during the ban. Read the forum...
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

What did Asda say when you expressed your 'frustration' to them?

I did not have a clue about these !!!!!!, I never thought someone could give you a ticket for displaying your blue badge, the ticket was 18/05/2018, I gave them my name and a false address when appealing, is this bad?

UKPC were banned from DVLA access at the time your ticket was issued

so they cannot apply to the DVLA to get your address

    UKPC cannot charge £160

sit back , it fou hear from them via royal mail , they have obtained your info illegally

yes it is bad unless they were banned at the time, the correct name and address should have been given or you should have waited for an NTK in the post

you should also be complaining LOUDLY on the asda website (Leeds head office) and getting it cancelled, PLUS you should also be insisting that asda add the VRM for this vehicle to their whitelist like they have done with mine, so that it never happens again

a landowner or retailer cancellation is ALWAYS the best option, plus prevention is better than cure

the pcn was not "unlawful", just misguided and tantamount to fraud if what you say is correct, so tell asda this, and warn them about their obligations under the EA2010 , because it is that law that protects YOU, not the BB

get the VRM on their whitelist and insist that ASDA cancel it , by raising a complaint on their website which also generates a reference too

if they write to you at yhour home address then return

however you may find they start a cc claim and get a default at the " false address"

this could prove to be a awkward situation to get a set aside , as you clearly stated it was an address you could be contacted at

I would be inclined to complain to the BPA, DVLA, and your MP about the underhand tactics of the parking scammer. Put your BB in the place it was on the day of the alleged event and take a picture of it so that it can be clearly seen, then take a pic from the same squatting position that the parking scammer used.

Complain to all of the above and show the pics you took, and the one the scammer took to show what he/she did in order to obtain money by deception.
Make the same complaint to the CEO of ASDA.

I suspect you'd now be looking for advice on how to defend a criminal charge!

Too clever by half. Quite likely the reason you've missed the boat to POPLA where this could have been completely killed off. What did you have in mind with the false address stunt? If they want your address, they're able to legitimately get it from the DVLA.

Too late for POPLA. Other than complain to the landowner (and I don't believe Asda are directly involved - their standard parking company is ParkingEye), it's a case of waiting to see what UKPC do next.

They have 6 years to pursue you through the county court.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
