Not sure if this the right forum or not, but don't know where to go.

I have an issue with xbox enforcement team.
It all started 4 weeks ago when my 8 year old son started to play on Fortnite with a new friend of his from school.

After having been on the xbox since last xmass and not have had any issues ever, I suddenly got an email from the enforcement team that his account was restricted for 24hrs for using bad language! NHow I have heard him shout on the xbox to his mates to say get out my way or I am dead, but never heard him use any back language. So we sat down with him ( he is 8yrs old and I am very proud of him as he is a very well mannered boy, top of his class and ... ), and explained to him why he has been banned and that it is not ok to swear at people. But he cried and was very upset and he said he has never sworn at anyone. But we had no choice to object this from MS and so we accepted the 24hrs.

He was back on for another 7 days, but then suddenly got another email to say that he has been banned this time for 7 days for using offensive language.

This time I had the choice to get a case review, and after 48hrs, they came back to me and explained to me that apparantely he had used very bad language ( I was sent the exact phrase that he had used which read in the lines of * u smell like sh*** you mother f**** ). the phrase was sent to me exactly like this 'u' and not 'You'. I was absolutely gobsmacked to hear that my son has used such language!

So sat down with him again and had a long chat, and again he was extremely upset and he promised he has never used any language like this.

Fast forward couple of days later, and he came home upset that one of his friends at school ( the friend he has only been playing with for 4 weeks) that has been bragging to his mates that he reported him and got him banned. He had explained exactly how he had done it and that he had reported him for bad language and then he had written what he apparently had said!

I was fuming, so told my son to block this person and not play with him. However he has turned around to my son and has told him if he doesn't play with him, he will report him again and get him banned for longer!

So now I am really annoyed if it is really that easy for someone to just make up something that someone has said and get them banned!

There is no number or chat with the enforcement team and you can only appeal the case online and then it takes them long time to come back to you.

I am at a loss as I now have a son who is afraid that he is just going to get banned straightaway again as soon as his account is live again only because he doesn't want to play with this lad!

What should I do or what can I do?

Is there anything I can do legally to force MS to send me the details?

  • 1. Microsoft don't just ban someone because a report is filed against them. They will listen to the chat or read messages then decide if it deserves a ban. Even if your son gets reported by his "friend" again it wont matter unless he does something to warrant a ban.

    2. If he gets banned again, he could just create a new xbox account and play on that one while he is waiting to get unbanned. You'd have to buy XBL Gold again for him to access online, but that shouldn't be a huge issue - its only £4.99.

    Two simple solutions:

    1. Take the microphone/headset away from your son, he will still be able to play the game but won't be able to talk to other players.

    2. Make sure he doesn't play with this new "friend" from school. I mean do you see how absurd this 8 year old's threat of reporting your son is if they don't play together? Let me spell it out; if your son and this "friend" DON'T play together then said "friend" will not hear anything offensive by virtue of not being on the same server/instance, and microsoft will (presumably) be able to verify that with records.

    And I can't believe how you are taking your 8 year old son at face value here. There's a fair chance that he is outright lying to you.

    Doesn't sit right with me the approach you are taking here. Aside from the fact that Fortnite is a game which has "mild violence" (I always find it funny when it is referred to as that when the premise is using weapons, often guns, to kill other players). As the poster above said, the PEGI rating is 12. A very quick google search explains this in more detail:
    What age rating is Fortnite? Fortnite has a PEGI rating of 12, PEGI have said this is due to the: 'frequent scenes of mild violence. It is not suitable for persons under 12 years of age'.

    Can't you like try and get your child into some more wholesome activities too? I mean in fairness when I was like 11-13 I used to play pokemon and the battles in the schoolyard with those connector wires got really heated! So I *get* how gaming is important to children, but there's got to be some sort of balance. And I also *get* how your son probably did give it large on the blower and just lied to you!

    As regards to the game rating, yes it is 12. But doesn't mean it is illegal to play it, like drinking if you are under 18, it purely means it is not recommended!

    My son, although not an angel, he is not someone who would have used such language. He has been given numerous rewards at school for his behaviour and his attitude. Everyone we speak to says that he is a credit to his parents. I do realise the older they get, more band language they come across which is why we ALWAYS educate our kids on use of bad language rather than punish them when they use it.

    His room is next to where we always sit. We hear him all the time shouting on the speaker and screaming at his friends, but have never heard him use any bad language.

    He has a child account with MS and we have set him screen time on his xbox so he is only allowed it for an hour a night.

    He plays sports 7 hours a week and a promising future tennis player. He already trains with a county team for tennis.

    We have trust together. One of his friends called him a wan*** at school. He came home and said Dad someone called me that word. what does it mean. So I can't imagine him using the mother f**** word when he doesn't know what it means!

    The notice from the enforcement team ( which apparently xbox support have no access to and is a separate team ), said : He has used offensive language saying ' u smell like sh*** and get out my way u motherf****'

    If this was a recording, and MS had indeed investigated it, why would they use the word 'u' instead of 'you' ? The only thing I can think off is that in the report they had received it is how it was spelt!

    As regards to getting a new name, it doesn;t cure anything. Fortnite is played in groups, and although he has banned the new friend, the friend can still join the games where my son is playing in. He can still go and report him again using whatever new username he has! So that won't cure this problem.

    The only way this can be resolved is if MS were more clear about this. I have no problem with them recording the audio for games and looking at them in future for investigations, but if this is the case and they have used, then why can they not send me a recording of this, so then I can sit down with him and then talk him through why it is not right to use that sort of language!

    Instead of me telling him he has used that language, him crying and say he hasn't!

    If this happens again, and they ban him, knowing very well that he doesn't swear, then I might have to sue MS under the consumer protection act, sale of goods act as I have paid for a service, Microsoft Live Gold, for my son to be able to play with his friends, online and chat to others. But they have unfairly blocked the use and not providing the service. That MIGHT then force them to either release any evidence they have, or something else.

    No offence but he won't be the complete angel you make out except in front of you and his teachers.

    He would have heard awful langauge by other players, so will be fully aware of what things are etc.

    Personally I think him coming home saying that the "friend" filed a false report to get him banned is just a good get out excuse so you still think he is an angel.

    As for the spelling from Microsoft - Could be the case that someone did report him for saying such a thing, Microsoft have listened back and just sent you the original report.

    As for taking Microsoft to court - Good luck with that one. They haven't unfairly banned him, they have banned him twice for effing and jeffing.

    Yes I have seen this and have read it. But I don't believe it. I find it a coincidence that since playing with this friend in the past few weeks that he has been having issues.

    When the kids had gone to bed, I sat down with my other half, and talking about the lad who is causing problems, my partner mentioned to me that this lad was excluded from school for 1 week few months back. ~No one knows why he was excluded, but he seems a bit of a disturbed child.

    I do think that this is the reason for his ban from MS. But I am going to do a test and see what happens. I will film the whole process, over the period as a proof and see if it really is that easy to ban someone.

    If it really is that easy, then it is a serious fault with their system. But I assume this could be due to the sheer volume of gaming users vs number of moderators to properly investigate something. Can you imagine even if there was a 1% complaint log against online players, how many cases they would have to deal with?

    I think you're taking your childs word at face value. If this friend is so bad, then not only could your child have picked up the langauge on xbox, but also via this friend at school.

    I have absolutely no doubt you are right. He hears things at school, when we cycle around, when he is at the club playing tennis next to university students playing football and swearing at each other.

    Hence why I said I believe in EDUCATNG your kids on the rights and wrongs instead of punishing them.

    But time will only tell. He will have his account back in 4 days time. We will then do a test and see what happens! My guess is that I think we will get him banned again! But I would love to be proved wrong!

    But despite your son receiving 2 recent bans for his behaviour you are still letting him play it and ignoring the age recommendations?

    Even if it is another child causing the nuisance is it wise for your son to be associating with that other child?
