    'its called credit clamping , it costs them £25 to do the dirty , then when you find out , you either pay in full in which case they will let you do uncontested set aside @ £100 or you end up paying £255 , which you will hardly ever get back , they are just being vindictive , they KNOW you will have moved , but hay ho they do it.'

    That needs to be dealt with in the PMB. They should not be able to chase these spurious claims for six years. It's not like someone has signed a credit agreement and had a cooling off period. These so called contracts that are supposedly breached are based on very dodgy signs in small print. Lets be honest who in their right mind would park somewhere they are going to be charged a £100 for the privilege?

  • I have also had a letter from Zenith Collections saying pay £160 parking charge to avoid them considering legal action against me. I was actually in holiday so one of my two boys must have borrowed my car.


    The letter doesn't actually say we will take you to court it says they will consider taking legal acting to recover the debt. They have offered to allow me to pay in instalments.


    Has anyone else received a letter like this? Someone says they are debt crawlers and to ignore them.


    Any advice will be helpful. Thank you.

    Why are you talking to debt collectors, they can do nothing, don't be scammed by these money monkeys and ignore their kind thought of a payment plan. THEY SPEAK RUBBISH

  • My mother died last year. I lent her my car in her last months of her life. SHee got a tick at the NHS trust... she had other things on her mind...


    Following a letter, I called DRPL to say I would not be paying the debt and they could take me to court. I was not driving; simple. The lady said, "that's not a good idea as the liability for this amount passes to you". I said this wasn't true under any circumstances to which she replied along the lines of, "I've been doing this a long time honey, and you'll regret it".



    My understanding is this:
    i) I was not driving the car, so I cannot be in breach of contract.

    ii) The driver is deceased and I am not her next of kin and have no benefit or liability to her estate


    I then add to this, there are new data protection laws in place, and ask is it legal for the NHS Trust who contracts the parking to a third party to then be complicit in the passing on of my data to a third party for the purposes of harassment and extortion in the way they are? I would argue, this misuse of personal data?



    By way of background, I am recorded as the owner of the vehicle in the NHS Trust carpark and, should it be necessary to do so, I can provide corroborative evidence to support that by showing the insurance documents that she was the main driver and her house was the registered address.



    Rather than pay the £130 fine, I'd prefer to put £65 in a pot together with others to see if there is a way to stop this practice of selling on information; for example, perhaps someone clever could at least argue that this practice is in breach of the new GDPR rules and generally make their lives as difficult as they are making ours.

    What youre missing is that for SIX YEARS now, since POFA2012 was enacted, the KEEPER can be liable for parking contract breaches.

    Yes it is legal, because they do not rely on consent to get your PII. Tough. It is not extortion. You do not understand legal terms, dont use them!

    No, you are recorded as the KEEPER, there is no record of owners. You can verify this by actually looking at your V5....

    HOWEVER - if you IN WRITING name her as the driver at time, and give her serviceable address - in this case, trustee of the estate - then you fully and completely discharge liability. DO NOT send this to anyone other than the parking company.

    There is no "selling on", legally. Your thoughts are wrong

    Now, you stop posting here, as this is someone elses thread you have RUDELY hujacked.

    In one of the letters that I received it said "you may be ordered to the court for questioning" . I did not manage to obtain a valid ticket because their equipment was not working (£3.00). I am not a serial killer.

    Zenith makes out that your claim has been assigned to them. This is very bad and against the FCA guidelines. I hope that when the new code of practice is introduced that all parking claims will be come under the FCA as disputed debts.

  • If the collection agents were regulated under the FCA their activities would be greatly curtailed. Under the Codes of Practice of the BPA and the IPC the PPC's are responsible for the professionalism of their agents. That is beyond a joke.

    The only way I would engage with these organisations is to acknowledge the first letter by telling them that the debt is disputed and to refer back to the PPC. Then ignore until the LBC.
