    i am in the same boat jacksgrandma,, tried to claim back ppi on a store card with ge money ... all they keep saying is we were not covered by fos when you opened your store card i complained to fla but nothing...not sure where to go from here

  • Hello everyone! - I've just discovered this wonderful site (I've recently lost my job and am in difficulties) - I now realise that my PPI was mis-sold but had no idea i could reclaim it!

    My question is this: I took out a car loan at a car dealership (having been told by the dealership's salesman that if I didn't take out PPI I wouldn't get the loan). The loan & PPI agreement are with the dealership's finance company. Moreover, the PPI insurance is underwritten by a third party. So... who do I claim against?

    My question is this: I took out a car loan at a car dealership (having been told by the dealership's salesman that if I didn't take out PPI I wouldn't get the loan). The loan & PPI agreement are with the dealership's finance company. Moreover, the PPI insurance is underwritten by a third party. So... who do I claim against?

    Hi there

    Sorry to hear about your job hun and hope something new comes up for you soon.
    Have you tried putting in a claim for these repayments now you lost your job? (this may help, but if not and you believe this was mis sold, then write to reclaim your ppi). Details below.

    Do you know if your eligible to take this to the financial ombudsman service if the finance company did not resolve your complaint?
    (even though they should let you know this in the final response if it goes that far).

    Do you still have the copy of the agreement for when this was sold to you?

    If not write to the ones who sold you this to get the copy, although you may be also to get this from the lender.
    Ask them to send you a copy of the agreement, and to cover to cost of this request pay £1 postal order or cheque payment for this, they should supply this to you by 12 days.

    However in regards of reclaiming on the PPI, there is a useful link here:

    There are letter reclaim templates to help you through this, add your own reasons, they have 8 weeks to respond in full.

    Another letter maybe required if not successful first time round, keep at them until you exhaust their complaint procedures, they will let you know in the final response in how you can pursue this further, for example the Financial ombudsman service if eligible.
    If not let us know and we can try out other ways if possible.

    The problem is if they have issued the final response they can oblige not to write back, but as they are not covered in order to take this to the FOS, I am aware they do not disclose details of the FLA either, but it may also be worth contacting the FLA to see if they have them registered with them, both British Credit Trust and their dealership.

    Hi, following my last message, I wrote to the Car Dealership explaining the whole situation and enclosed letters of communication between myself and the finance company. Yesterday I received a letter back saying;

    With reference to your letter dated 7th March we have investigated your claim and can advise that after consideration and having spoken to the Financial Ombudsmun Office, your alleged claim does not fall within the Ombudsmun's jurisdiction.

    With this in mind, I am afraid to advise you that we will not consider any settlement with regard to your alleged claim for the following reasons:-
    The Insurance you took out was purchased prior to the group being regulated (14th January)

    The insurance product you took out was terminated prior to the group being regulated (14th January)

    You still have the right to refer your complaint to the Finacial Ombudsmun Service at the following address:-

    South Quay Plaza, Blah, blah, blah!

    Where do I go from here?:confused:

    But all is not lost yet.

    I really don't understand why they state you can still refer this to the FOS where they also made a note of letting you know they were not under jurisdiction at the time you had taken out the finance.

    Right, hun, if you decide to take this to a solicitor, do not pay for anything upfront, there are a few free services, but its always best to get as much advice and info as possible before using these services.

    I will get back to you soon and keep a look out for other posts as well.;)

    I've being reclaming insurance on some items that I don't realy need and could let go if things get too bad. That said I'm keeping payments insurance on some items.

  • Many thanks to Di3004 for her very good advice... Anybody had any luck with "Statute Bars"? I'm told that I can't complain because the loan agreement / PPI started more than 6 years ago (6 years and 2 months!!!). Is there a way to get around this - or do I give it up :cry:

    That is very frustrating I know,

    Due to this you could look at other options here, if you use a claims company do not go for anyone who charges upfront, there are few free services, but again always get advice before using them first.

    But yes there are ways around this, hopefully others will post with some useful suggestions here for you as well hun, good luck.;)
