Had another loan with Black Horse before January 2005 but unfortunately was told by the FOS that they weren't members then so can't claim my PPI etc...... Does anyone know if it would still be possible for me to go through the courts? TA xxxx

    Hi there

You should have the opportunity to take to small claims courts, I have never been that direction, but sure many have, also check this out here:

Good luck with whatever you decide to do.;)

IN 2005 we rang Norton Finance for a loan who then introduced us to First Plus.

So after a couple of years and looking into the debt we realised how extortionate it was and that there was something odd about it when we asked for settlement statements. Eventually realised it was the PPI

So tried to complain re mis-selling to First Plus who said it was Norton who had sold the policy. norton agreed they had sold the PPI. I sent my complaint to FOS who said that Norton were not regulated so they cannot deal with the complaint

I have complained about unfair rebate instead with First Plus

    Hello Di,
    Im good thanks xx
I still have no news

It makes me so cross to think that Norton and First Plus get away with selling these Policies.

I have just double checked and my first letter from FOS aknowledging FP complaint was 4/7/08 so we are getting on for a year and it still hasnt been passed to an adjudicator.

I am wondering if i should send extra info complaining about their witholding information on payments between themselves and Norton and trying for Mis -selling from FP

The actual loan agreement has both the loan and PPI amount on the same page and is headed First Plus so surely they have sold it to us???

Norton only directed us to them??

Or am i clutching at straws :D

I work for a firm of Solicitors and actually run PPI cases myself (I know a lot of people disagree with firms charging and making money from the PPI scandal, but we tend to take on the more complex cases where genuine help is required).

I believe following a development this week and extensive discussions with FOS that cases that the FOS would previously not look at are no longer barred, I have been informed that the date the advice was given is no longer relevant and they will look at anything PPI related, regardless of the date taken.

I am happy to give FREE advice to anyone looking for assistance, please either PM me or get in touch via Pinto Potts Solicitors.

    Hi there

    Thanks for posting this.

So if you don't mind me asking, if a case of say year 2000 and that company were not under jurisdiction as such, for example the GISC before the FSA came in, are the FOS now able to investigate those complaints as from now then?

A few of us in the past have had ours thrown back at us from the FOS as they were not covered by these regulators of when we taken out the policies.

    Cheers.

An interesting development. Now how long is the delay going to be if they can now deal with more claims? If they are only currently looking at cases presented to them in Jan 2008 how much longer will the wait be?
