PPI Reclaims not covered by the FOS

  • I took out a loan with RFS in 2001 for 17500. They added 9250 in insurance and it was a condition of my getting the loan. They then added interest to the total over 10years. When I used your template letter they told me the company had been taken over by RCI in2007. I sent letter to ombudsman who said because it was before 2007 it was outside their jurisdiction. The company RCI says they didn't sell and don't sell insurance and so it's not their problem. I was not given an option at the time it was a pre condition. Help!!

    Can you let us know who RFS are then we can check them on the registers etc.

    Was it Renault Financial Services

    RFS was jointed owner by RCI Banque' which incorparates the Renault-Nissan Alliance Group.
    It was operated in the UK through Bank of Scotland, and was based in Chester


    In July 2007 RFS was taken over by RCI financial services.

    As they were part of the Royal Bank of Scotland could you not make your claim through them maybe....
  • Yes that's them - I have had other problems with them too but have just about sorted that through the FOS (they simply stopped taking payments then accused me of defaulting!) But as I say that's on the verge I think of being dealt with- that doesn't however sort the ppi issue. Thanks very much I will follow the link

    Hi there, not sure if this will help anyone, but whilst watching our dear Martin on it pays to watch on channel 5 there was a lady in our boat not covered by FOS and he told her to contact a Claims Handling Company (not his favourite choice) but MAKE SURE IT'S ONE THAT ONLY TAKES 25% OF YOUR WINNINGS!
    The thing is my reclaim is for £181.80, they (REDCATS - BETTYSTUARDS) Gave me back £32.72 as an offer of goodwill, months ago and despite my continuos battle they are NOT giving me anymore!! I even wrote to their Ireland office - No reply though! AND THEY KEEP CHEEKILY GIVING ME FOS leaflets, knowing full well they were not regulated! Di, Marshallka I'm exhasted!!! Thanks for al your previous tips. But I say with a tiny smile...I aint given up yet!!!!!

    Ok....I have jumped in!!! Lets hope I dont sink.

    I have sent one last letter (well 2 actually) one to the person I have been dealing with and getting nowhere and one to the complaints dept.

    I have asked for a full refund one last time, quoting their sent literature over my policy (had to request it from them as I never got the policy documents)

    QUOTES FROM MY LETTER

    “We will advise and make a recommendation for you after we have assessed your needs for Total Cover.”

    “The FSA is the Independent watchdog that regulates financial services.
    It requires us to give you this documentation. Use this information to decide if our services are right for you.”



    “If you wish to register a complaint, please contact us.
    If you cannot settle your complaint with us, you may be entitled to refer it to the Financial Ombudsman Service”


    But at the time I was sold the Policy, you were not under the Jurisdiction of the FOS. If this was the case, why was this statement in the policy? This was incorrect and misguided information again, at the time I was sold my Policy.

    Instead you chose to send me the FOS documentation, knowing full well that I cannot refer my case over as you were not regulated when you mis-sold me the Total Cover Policy.

    “Are we covered by the Financial Services Compensation Scheme (FSCS)?

    We are covered by the FSCS. You may be entitled to compensation from the scheme if we cannot meet our obligations.”

    On your letter dated ******, you felt that your refund of 3 months charges plus 8% totalling £****** was an acceptable compensation offer. I feel I am within my rights to disagree with this compensation amount and request the full amount.


    I am therefore asking again for you to please apply this full amount to my account within 14days.

    Failing this I shall be contacting the FSCS, and I will proceed this case to Court to retain the amount immediately.

    END

    I am so nervous about doing this, as I have never done anything like this before.......I have even saved my local Court House in my favourites in preparation!!!

    Oh guys n girls...I'm sending it 2morrow after I drop off my dd at nursery..Wish me luck:o

    Who is this about angel?? Who are you complaining to? Also if they did send you documents stating on the policy that you can take your complaint to the FOS then this may a complaint you can take to the FOS about unfair rebate against the insurer of the policy and not the lender or broker. I have a complaint in for unfair rebate of the PPI policy and it has to be made against the insurer and not the lender so FOS have told me. This is then under compulsory jurisdiction.
