    I'm trying to gather up the courage to take Next Directory to court for my PPI. I think its the only way I'll have a chance of getting it back, as the FOS can't help :rolleyes:

    Hi hun no problem, infact I see mine going this way, I am trying to pursue on an unfair rebate with mine with the lenders which are Endeavour as the last option with these because for the mis selling the brokers Click dissolved.

    Endeavour the lenders were not registered when I had the loan with these in 2004, it was a 25 year secured loan with added ppi and paid off Nov 2005, (24 yrs earlier, and only given a part rebate), so it worth a shot - afterall we were deprived of this money.
    But the way its going it will be court for me too.:D

    The sale of general insurance has been regulated by FSA (and therefore within FOS compulsory jurisdiction - if UK company) since 14 January 2005.

    The FOS can look at complaints about sales before this if the business was a member of a predecessor scheme such as GISC.

    AND the FOS can consider complaints that are about an activity that is anciliary to a banking activity before Jan 2005, such as bank or building society sold a loan and the PPI is related to that loan.

    It is not correct that FOS cannot consider a complaint about a sale more than 6 years ago. The relevant rule says that the event must have occurred less than 6 years ago OR were aware of a problem less than 3 years ago, whichever is later. So if only aware of a problem within last 3 years even if sale was more than 6 years ago FOS may be able to deal. And this rule only applies if the business raises a specific objection to the complaint being considered by FOS.

    DISP rules are the ones that apply to FOS.

  • just filed a claim online against ge money for a ppi taken out in 2000 as a lump sum. loan paid back 2002 but no refund for ppi. wrote letters, rejected, went to ombudsman, couldnt help, contacted f.l.a., didnt want to know so im going it alone! they have until 9/10 to defend or acknowledge claim, so fingers crossed they dont bother, but if they do then im prepared to go all the way. bring it on all you big financial institutions! have had phenominal success reclaiming thousands from other companies so have the courage to take 'em on!
