    I've had a look at the info you suggested and have gone back over my Black Horse file. I had printed the Wilson and another v Hurstanger Ltd & sent it with one of my letters to Black Horse a few years ago, but have read it again and the date on it is now April 2007, so it must have progressed since I last looked at it. I have used the templates available,but they have been a mix of what I have found on this website and others. Black Horse's replies do not match up with the templates and they have been very sly about not saying the things that they are supposed to in order for me to follow the comlaints procedures - ex. I had to specifically ask them for their "full and final response" as in each reply they leave the door open by saying something is still under investigation.

    Anyway, I have given up trying to navigate this mayself and have started the process to hire lawyers.

    Thanks for your help - I thought I was fairly knowledgable about these arguements and processes, but Black Horse has built in their own loopholes. Not really surprising seeing as they make up their own rules and laws.
  • Just wondered how you got on, did you manage to get a refund using FLA complaints procedure. My case is much like yours, I am also going to try FLA service. Thanks for the help
    I complained to First National Motor Finance - a trading style of GE Money Home Finance ltd (they have been fined by the FOS as per the front screen of the PPI article) and was fobbed off in the same manner as it seems most of us have been - not regulated at the time of the policies sale :mad:

    So I did a bit of digging.

    The Finance & Leasing Association (FLA) have a dispute resoloution service.
    This can be utilised by anyone who has a complaint against a current or past FLA member, which convieniently enough GE Money have been a member of since 1992. Nice that when the wrote to me telling me the FOS has no jurisidcition over my complaint they omitted to mention the alternative!!

    The FLA can be contacted on 020 7836 6511. They can tell you if they company was or is a member.

    The FLA also operate an online complaints form:

    The form is much the same as the FOS one that we have all submitted with great care I'm certain. Copy and paste the relevant sections of your complaint onto it and you can then email it off to the FLA who, in my case, responded within 2 days.

    I am still awaiting a result from the FLA - it has only been a week now - but I hope that this is of some use to everyone else.

    Still no progress from the FLA. They have done absolutly nothing - to the point where I question why they are acting as a regulatory body. The last response I received from Black Horse had really weird things in it - saying that the salesperson passed us the full terms & conditions of the PPI, waited for us to read it, then passed us the paperwork to sign. This is absolutly not true and I responded by asking them to prove this. I sent the response through the FLA,as instructed by the FLA. The letter was sent on 21st April 2008. Surely a regulatory body should at least answer the complaint letters sent by recorded delivery?

    I've turned to lawyers. I will keep any progress updated on here.

    Not sure if anyone has answered you - my Life, Accident, Sickness, Involuntary Unemployment and CriticalIllness Policy says ont he last page at the bottom that "This policy is underwritten by Lloyds TSb General Insurance Limited (Company No. 204373), Registered in England, [address], and The Prudential Assurance Company Limited (Company No. 15454) Registered in England and Wales, [address]. This policy certifies that you are insured for life, disability, involuntary unemployment and critical illness cover depneding on the level of cover stated in the credit agreement.".
    However, the FLA now says that I should take issue with the insurers why they told me that our claim was turned down based on my husband's self-employment when we didn't have the cover at all based on the tiny clause in the policy that states "(This cover is not available to the self-employed. If your employment status changes after the start date to self-employed,cover under this section will cease, and you will automatically be covered instead for Critical Illness).

    The FLA said for me to contact the insurers and not Black Horse about this. This does not clearly state what happens to people on fixed-term contracts or temporary employment.

    Hi folks.

    The FOS could not deal with my Endeavour/Click loan ppi complaint, tried it just in case but received a letter which said:

    From the information you have provided, it would appear that we cannot deal with your complaint because the business is not covered.

    I should explain that the Financial Ombudsman service has taken over the role of looking into complaints about businesses from 6th April 2007. As event you are complaining about happened before this date you may wish to refer the complaint to the Financial & Leasing Association, I have provided the details below:

    Now checking on the FLA I don't think these will be able to do anything about the problem either, because again Endeavour was not regulated until Jan 2005.

    I submitted a claim complaint in April this year with FOS as suggested when the company involved rejected our claim. the PPI involved was purchased in Sep 2004.

    FOS have now replied to say that this is outside of their jurisdiction due to the fact that "selling of insurance became a regulated activity in January 2005"

    Apparently because this PPI was taken out prior to this date there is nothing they can do.

    Anyone got any advice?

    Sorry to hear you have the same problem as myself here.

    May I ask who your broker was who organised your loan ? If arranged by a broker ?
    Even though the lenders of mine were Endeavour, it was those of Click Finance Limited who arranged our loan.

    If your was arranged by a broker find out who, these may have been regulated by the GISC regulators if opted in for this, as not all were members of these but if your brokers where you can still try to pursue through the brokers, and if they don't uphold your complaint and regulated by GISC you will be able to go to the FOS with these.;)

  • Bumping this thread so folk can find it - it had dropped off the first 10 pages of the Loans board.

    Is it possible to make this thread into a sticky please? Hopefully then those folk who have a PPI claim that isn't covered by the FOS can come here to get advice.

  • I have just had this reply from the FOS about my complaint against Littlewoods Finance. "The Financial Ombudsman Service are unable to deal with the claim on the basis that the complaint against little wood finance company Limited concerns events which occurred when it was not a member of the General Insurance Standard.

    Whats the next step?
