I still can't believe you think he broke it trying to get the back off. It's a sad business but there are loads of scammers buying perfect phones and claiming they're broken then sending a broken phone they already have back. The fact this guy is buying and selling broken and perfect condition versions of the same phone points directly at him being a scammer.

thanks bamber... but i cant prove it. and im sure eBay/Paypal wouldn't take it into consideration.. Also, the IMEI numbers match up

Although these IMEI numbers match up, are they the phone you sent him? (If he bought a phone off someone else they may well have had the box it came in to send it to him in.) Have you checked with your original supplier to see if they can confirm your IMEI, or, what about asking whether this IMEI is allocated to you?

His buying history would not support his defence in court, especially with the packing.

Hi FloFlo, he did return it RD I could try the IMEI trick (as its printed inside the phone) but im not sure what the number was of the phone i sent..

I could try calling his bluff and say i have contacted the police..

Was it sent RD or SD not all RD tracks, put the tracking number into the royal mail website.

hi, if i was you i would contact ebay yourself and explain you're concerns, if he is buying new and damaged phones of the same make and model then it will surely back you up, it would be better for you to get in there first with ebay, i'm sure they are aware of such scams and will help you.

the comment today was won on a phone he paid 200 an odd for but he purchaced the same phone 8 weeks back for 80
that to me doesnt add up i think the seller of the 200 an odd pound fone may have found him self in the same shoes as you if he hadnt have been asked to post to nigeria
