Ahhh i dont know what to do. If i say outright i will not be refunding him, surely he can just tell paypal / ebay, and they will take it from my account!?0

Did you get a chance to check if there was an IMEI printed anywhere on your box or on a sheet of labels bundled with the manual inside the box? If its different to the one on the phone then this would give you some backup to your claim.0

Ill call T-mobile tomorrow, perhaps they have the number on file. If it turns out to be the same phone, i still believe he mis-handled it getting the back off resulting in the broken screen.0

ive checked the IMEI number on the back of the phone and it matches the one on the box, he has also emailed to say he knows it was delivered back to me on the 28th, and wants to know what is happening.. looks like i cant prove anything, so will have to hand over a crisp £50 to the little chav.0

Can you not say 'actually, the UPS packaging is in mint condition, therefore the phone was damaged in your possession as I have witnesses to prove that the phone was in perfect condition when sent etc'? ... (or something along those lines)0

good point if the packaging has no damage how come the phone has,makes no sense.Or you could say you posted out a postal order and when he doesn't recieve it oopps it must have been lost in the post and silly me never got a proff of posting.0

Do not refund by any other method than paypal if paid by paypal.0

OK, i think im gonna go with Meerustar's suggestion.
I can reply to tell him im looking into the damage, and return the phone (so hes not expecting it and signs for it) then I can stand my ground and explain that the phone was fine at this end, and UPS can cover the transit.. and therefore i believe that he has broken it at his end. Then stand back for the fireworks, the negative feedback and him trying to get his £50 back through paypal...
