Thank you. If am required to submit a witness statement in the near future as part of the process, doe this have to adhere to referring to my self in the third person as 'the defendant' or can I use 'I' after having confirmed my status as the defendant?
You are required to submit evidence, and a WS is best too. There are examples of typical evidence (I list some things to consider using as evidence) and examples of WS for you to read, to see the style, in the NEWBIES thread. Update from hearing mid-Jan.
The legal rep seemed like a nice bloke and I felt a bit sorry for him. The court had misplaced the claimant's WS, so the judge chose to rely upon the relevant copies brought by the legal rep. Not certain, but from looking over his shoulder, I'd say it's possible that these copies were in some way deficient (in comparison to claimant's original WS and my own WS).
The judge went through the formalities at the beginning, when left me feeling a little bit apprehensive. However, there was some information that the judge required from the claimant / their rep, which the judge and the claimant's rep could not see within the copies that they were reliant upon. It was a bit surreal, almost like I wanted to help them. But neither of them asked for my assistance, so I kept my mouth shut. The legal rep was very easily put on the back foot by the judge, who allowed him to flounder for a few minutes before announcing that the case could not continue any further.
I went in to the case believing that my defence had been a very poor document but my WS was far better and a well reasoned piece of work. However in the end, although I felt prepared, it seems the legal rep was less prepared.

Cheers. I didn't really incur any monetary costs. The only costs incurred were time and stress related. Maybe some impact upon partner etc. I found it particularly difficult to compose my defence, but when I got to the witness statement stage I was able to grasp and express arguments much better (as well as stating the facts). TBH, I think Excel pursued the wrong case. They were OK to deal with on the occasions I contacted them, but I think will be better examples of breaches in their car park than the one which landed myself in court. I got the feeling that the judge may have held some sympathy for the defence case on this occasion.0 -
Hi any help would be great as I haven't got a clue what to do just received a county court letter of VCS for breach of contract in 2015 but can't remember if I was driving my car that date0
