Hi, I have followed the instructions aimed at newbies for LBC and checked the examples provided. I may be mistaken but they seem pretty specific - and I was wondering whether any regulars could provide some helpful pointers re my own situation?

After reading up on this forum, I have not responded to various letters. The charge has now gone up from £100 to £160 or £192 depending upon circs. I received LBC directly from Excel and was supposed to pay within 30 days. If my response is too late will they just automatically go to court? No photo evidence has been provided in their communication.

    The newbies faq thread emphasises that you should never reveal who was the driver


    You need to edit your post to remove details of the driver.


    The ppcs monitor this forum and can use your posts against you


    Follow the advice in #2 on responding to a LBC - are you sure you have actually got one? (A properly composed one would give you 30 days to pay, not 14)

    I have amended again after checking the letter. It does say '30 days to pay'. If it goes beyond that - is it too late to respond?

    It may be to late to effectively respond, as they have given warning that a claim will be issued after 30 days.

    Why delay?

    Just send a robust response now - from post #2 of the NEWBIES FAQ thread.

    KeithP, thanks for response. The purpose of my thread was to try to find which example in that section was most appropriate to my circs. I'm guessing the purchased council parking ticket is irrelevant?

    There's only three LBC responses there.

    Pick the most appropriate bits from them all if you wish.

    You are wanting to pick apart their LBC, point out their failings and ask for the information they are obliged to supply but haven't.

    Update. I adapted one of the LBC responses on this site and submitted it to Excel. They responded, attempting to answer my points. The problem is, I'm really not sure how far their answers go, in terms of effectively satisfying or rebutting my points (for example if it went to court). My response to their response went on the back-burner so to speak. Now they've issued another letter expressing that because we've failed to reach an agreement, they are about to pursue legal action.

    Which course should I follow now?

    Thanks for reply Quentin. What I meant to enquire about is: While awaiting any court action - should I attempt to pick apart their response to my response? If so, bar one or two points, I haven't got a handle on how robust their response is in legal terms.

    Nope, don't waste your time, it will be the usual template dross.

    Concentrate now on reading lots of Excel defence threads.
