  • I have contacted Parrott and Coales solicitors this morning and still waiting to hear back from them. Left a msg with the Secretary.

    Union too will get back to me tomorrow. I will deal with this this week then if no luck, I'll apply to court for payment plan.
    Yet to contact scs law to ask what payment plan they are willing to accept.

    Please do some research on this. I can't give you chapter and verse, I'm no expert, but there's something in the back of my mind that says that even though you set up a payment plan, the CCJ isn't satisfied and your credit rating is as shot as if you'd paid nothing at all.

    Not meaning to alarm you, it's simply a heads up - and I'd be delighted to be told that I've got it wrong.

    Indeed, unless a CCJ is paid in fgull within the 1 nmonth, it is just "unpaid" and then "paid" on your record, as opposed to being removed entirely which it would be if aid in full within one month.
  • Good morning all, Union has called me back now. They said because the court has passed judgment, I will need to check with the court if I could appeal. Also, the additional £60 was not in the contract btw the Trust and UKPC, however it is in the reminder letters that UKPC was sending out that if original £60 was not paid, then a further £60 would be added. So basically what they are saying is the £60 was valid.

    Solicitor from Parrott & Coales LLP, has not called back. I left 2 messages yesterday......it's either they are very busy or they feel my case is a lost cause.
    I think my best option is to dust out one of my credit cards and pay it all off and get this over with. Thank you guys for your support throughout this craziness. I hope the UKPC guy gets what's coming to him one day! He's such a big bully!

    They cannot add on £60 ad lib, the contract was the max price of the ticket and that's it.

    Are they getting confused with the discount offered if paid within 14 days ???

    No I did explain and she said because it was already stated on the letter they sent that if the £60 wasn't paid then a further £60 would be added. I told her the letter was not a contract between the Trust and UKPC but she said that doesn't matter.
    I will call the court today then and see if anything could be done.

    I know, I'll take this one final step of speaking to court and if there is no hope then I'll pay up. I woke up with a banging headache this morning. I haven't had a headache in 7 years and was for extreme morning sickness. This court thing is not for me!!!

    Wait till you speak to the solicitor, if the time to pay is not up.

    You would kick yourself if you paid, then they came back & said they'd do this pro-bono and felt there were issues of law to appeal on.

    Give yourself the max time you can on this, before paying
    Bear ni mind while the claimant is suppsoed to inform the court the debt has been paid within 1 month, they dont have any sanctions agasint them if they DONT do that - and you suffer. So make sure you have a means of informing the court yoruself.

    For an appeal, you really can only focus on finding a point of law that the DJ misdirected themselves on. Findings of fact are almost impossible to overturn.
