You don't think I should appeal?

Whether you do or not is your own choice as you know the case better than anyone.

My point is for the others and those that argue "unfairness". Almost everything in law has an understandable definition. To understand "fairness" you have to think in terms of the balance between the parties.

A term is "unfair" if there is an imbalance between the parties e.g. surprising people with hidden terms or terms after the event.

In the UKPC case, the £30 and the additional £60 would have been (but correct me if I am wrong) on the signs - the contract. You might have missed it the first time as it was not totally clear but after the first ticket the chances of proving an imbalance between the parties decreases rapidly.

I have not read this thread, but I have read post 112. I get the impression that many here think that the judge has not understand, or has misapplied the law.

In which case, If the judge has acted incorrectly, i.e. outside the law, surely it is it worth asking the Judicial Conduct Investigations office to investigate.

    https://judicialconduct.judiciary.gov.uk/

If they refuse to deal with it, (their default position imo), you can elevate your complaint to the Judicial Review and Conduct Ombudsman.

    https://www.gov.uk/government/organisations/judicial-appointments-and-conduct-ombudsman.

You have nothing to lose, It costs nothing and, if there have been similar complaints against this judge, he/she may be sent for that solution so beloved of the constabulary, "further training".

As I say. I have not read the thread, so could you please tell me OP, what action your MP has taken.
You never know how far you can go until you go too far.

But let's see what the Jopson case solicitors say when you ask them.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I didn't involve my MP in the end.
  • But let's see what the Jopson case solicitors say when you ask them
I'm calling them Monday am and probably meeting with them if they have an appt slot for Monday as I am off.
  • Unless the do it pro bono or it's covered by some policy then you will find it very expensive. I personally think you would be wrong to appeal but it's up to you at the end of the day.

I will see what the solicitors think. Let's say they think I have a good chance of winning but they'll charge me half or most of everything I saved then its not worth it for me. The emotional aspect of it is too tiring. I hardly slept the night before my court case going through all my statements and some law quotes which I didn't get to use as the judge didn't even bother.
I felt like I was back at school! So if I am not going to be keeping most of the £810......I'm out.
    Thank you.

I would say you are looking at 1K paid on account. By this i mean you would have to pay approx £1K before they start any work.

You may be right but they should hopefully offer the OP a free half hour of advice, so she can be fully informed before paying a silly amount to scammers.
