    Guess what my judge said?
    She said I work at the hospital daily so I should know all the places with double yellow lines.
    Terrible. A bumper overhang is not in contravention, if this had been on-street with proper council rules.

    If she didn't consider the test of fairness, then she erred in law.

    If she didn't consider the signage clarity, then she failed to consider the contract, too.

    I've just remembered that a Deputy District Judge Wright at Oxford erred in law and had her decision overturned on appeal:

    Was your Judge DDJ Wright? Maybe she needs another appeal against her...so she gets sent back to the drawing board and stops doing this to people.

    Are you up for appealing instead? Costs you £100 as a court fee. Think about it.

    Miss Jopson used Parrott & Coales LLP, Aylesbury HP20 2RS, according to that decision. completely different facts, different car park, but worth knowing that a solicitor-led appeal might be worth it, given you are fighting a large amount. Or consider doing it yourself if you are up for it.

  • I think I was just rubbish at this defence thing. Not my forte. But I did manage to knock some tickets off so not bad for someone who's never seen inside of a court. Having said this, at some point inside that room, I felt like the judge was the claimant's lawyer and I thought I had no chance whatsoever. But heh, 2 tickets got knocked so thanks to you guys, for me that's still victory!

    Also you know I mentioned about the solicitor taking more pity than the judge, when the judge asked about the charges to add on top, he only gave breakdown of £210 and the letter I received had £613 to be added on top. So he was not expecting to win all £120/ticket.

    The appeal £100 is waived if you qualify under income grounds, for help with fees. If you do, I'd think about appealing this...

    Yes she did and I did mentioned that from £3/day, they upped the charges to £120.00 and she said I could have paid it when I had the chance to pay less.
    I've just remembered that a Deputy District Judge Wright at Oxford erred in law and had her decision overturned on appeal:
    She is a Deputy District Judge alright but not Wright.... I can't remember her name. I was sent a letter that Judge R R Matthews was the judge but when I got there this morning I was told a different Judge, but I don't think it's Wright.

    they upped the charges to £120.00 and she said I could have paid it when I had the chance to pay less.
    They could not add damages. Not recoverable for a private parking charge.

    so roughly double what they are allowed for 5 tickets @ £60 plus court fees

    doesnt seem right to me either, so an appeal may be in order
