Yes I agree, and have warned them I am ready to go for set aside without consent!

Pity you haven't applied for a new credit card today and been rebuffed.

An episode like that would send most folk gunning for compensation against a negligent company who requested a ccj by default when the debtor had already advised their serious error

    If you get my drift

    I totally get you!
I am due to remortgage to buy out an ex partner, so the stress and pressure has been huge as my hands are tied and the ex partner solicitor has been really pushing! Still can’t do anything until my credit file is whiter than white!
  • I might be inclined to apply especially if the Claimant is likely to mark the CCJ as paid rather than get it expunged (but it's unclear what they plan to do as far as I can see).

Presumably you have paid for credit reports as part of the defence that you'll want to reclaim - so it's not merely about time cost.

I’d wait for Johnersh or LoC123 to comment with regard to item 3.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Cross out 3, sign it, send it back with a list of costs/expenses incurred otherwise the OP will go for a set side without consent plus DPA breach, as helpfully admitted in that very same letter?

Definite complaint/follow up to D. Durnford, query to DVLA asking who requested keeper details, and why two reg Nos were given insead of just the correct one as they (DVLA) have also committed a DPA breach.

Also, complain to your MP, and add contact WHICH as per this thread.
