A recording is often not worth the paper it is written on. As Catfunt says get everything in writing. Email is fine and counts as writing.

First thank you for the help!

Nope only thing I’ve had from court is judgement for claimant.

I have recorded all my phones calls too.

Next question.. have you moved house since the parking event?
If not, then something has gone wrong with you not getting the claim form.

No I have not moved home.

But have an autistic son who moves things, thinking hes helping! I found Judgement for claimant down back of chair a week after the Gladstones letter!

I've looked for any other court letters but nothing is here!

timeline is this ( dates from letters so not date received):

    • Said offense on 1st August
    • First contact from Minster BW on 5th Sept ( but stated a letter before, which was never seen.

    • I wrote to them.

    • 21st Sept Letter before claim Gladstones

    • I wrote to them.

    • No answer so emailed on Minster BW 19th Oct

    • Got reply on 20th Oct from MBW saying

    Good afternoon,

I can confirm there has been a system error, please ignore any letters sent to you while we investigate this on our end.

    Kind regards,

    Harvey

    • 20 Nov Judgement before claimant from Northampton CC business centre.
    • 1st December Gladstones letter saying payment in full within one month or CCJ hits.

    • 5th Dec contacted court who say CCJ is on file now and sent set aside forms. Also flied appeal on Gladstones online and e-mailed Minster BW.
    • 11th Dec Email from Minster BW
    Good afternoon,

We are dealing with this matter internally. Once we have resolved the issue, we will email you an update to the situation.
    Kind regards,

    Harvey

So one question is timeframe, as I've been left hanging with no response is there any date I should start the set aside or give them time to repond?

    Thank you guys and gals!

do you have a postcode/address for the car park?
their agents have caused you a great inconvenience, and the car park owner is jointly liable.
You will get fobbed off if you do not say the right things.

So let's get this straight, you have received a parking charge notice which wasn't meant for you. So i assume you still have it showing the incorrect VRM?

After that, you have received nothing until the CCJ? So no particulars of the claim?

You should then ask for the judgement to be set aside stating that you have not been correctly served with the claimant's particulars of claim. It seems that the court has already sent you the appropriate forms so I suggest you fill them in and send them in asap.
    PLEASE NOTE

    thanks for help

Minster BW went to DVLA and got details for 2 keepers one with a Y and mine with a V, the picture shows a Y also 3 door lighter coluor and sunroof which mine does not have! So Y should have been chased!

So move on set aside now then?

There are 15 companies listed at the address I have, I've tried contacting some but say they can't help! should I push more?
  • you can find out owner from land registry, it will cost you £3

Write to Gladstones now, copied to the PPC direct, saying that they have fobbed you off long enough, you are going to have to apply for a set aside unless they confirm within 48 hours that they will consent to that and pay for it.
The email to you of 20 October must have been AFTER the proceedings were issued, or at around the same time. They expressly told you to do nothing, but then days later issued? This is clearly their fault.
I'm guessing things did arrive, but were moved by your son. And of course you weren't looking for them because of the 20 October email. As of 2 days ago they were STILL telling you to do nothing.

Whilst thats of some use, what is this mysterious address you have??
There is no reason to hide it, as you have nothing to hide, and people on here may be able to help you find who is responsible

I have emailed Gladstone’s yesterday saying if they don’t set aside at their cost I will proceed without their consent and go for costs.

As for starting set aside, the court date for payment for judgement for claimant is Monday, so do I need to get my set aside in by then or does it not matter?

    Thanks!
