    Okay need help guys and gals!

    I need to reply to this email, does this sound okay? Have I covered everything?

    Good afternoon,


    I now need swift action on this, on the following points:


    1. Gladstones to contact me directly by e-mail to confirm they have accepted Minster Baywatch's request for cancellation.

    2. In writing from Minster Baywatch and Gladstones that no further action will be brought against me, including halting all debt recovery and forward legal proceedings on this case apart from set aside with consent at Minster Baywatch's cost .
    3. In writing that the CCJ has been removed from my credit file and my credit file is unaffected by the Judgement for claimant.

    4. In writing that set aside with consent is being brought forward to the court by Minster Baywatch and Gladstones at no cost to myself.
    5. Proof from the court that set aside with consent has been granted by the court with no cost to myself.




    I am now fully prepared to go for set aside without consent with additional costs to Minster Baywatch and Gladstones, so need your immediate action on these points.

    I suspect Mr Dunsford (DVLA) may well aware of this post and acting as we speak with regards to minster baywatch

    CPR27.14(2)(g) sets out that
    - while normally in SCC you dont get costs
    - if one side has been unreasonable then actually you do get them

    This pretty much fits the bill for "unreasonable"

    OP - Gladstones act under instruction of Minster - so its not a request, its a "oh !!!!, yoU MUST get this judgement removed"
    They should be sending you a set aside with consent order, at THEIR cost, I believe. This you sign and get to the court.

    Spoke to court today and they said they would most probably mark it as paid in full, in time, to save themselves costs which is a total lie!
