Parking fine but not my car wrong ANPR details

Hi all,
I received a parking fine for parking in Sheffield on 1st august which is 2 hours away and I don't go there, with someones reg number which is a Y and not a V, not my car! I e-mailed them to tell them their mistake and was told to ignore anything while they investigated it. Now I have a court judgment in the post. I've also got video evidence I could not be in Sheffield and sent pictures of my car which doesn't have a sun roof, spoiler and its a different red! This is from minster baywatch and now Gladstones Really don't want a CCJ, so looking for help!

    When you say "judgement" do you mean a claim or a judgement in default?

    Do you know whos car park they operate in?
    you should be making noises about a data protection act breach, coupled with demands for them to stop pursuing you

    That sounds like a default judgement. Did you get paperwork from the court before this?

    For the sake of clarity, what letters have you had form the parking company?
    If you had genuine court papers and ignored them you could be in a spot of bother, and it may be difficult ( but not impossible ) to resolve.

    again - do you know whos car park the cameras were/are in? do you have any details such as an address etc?

    No details of business car park, just address and postcode which after investigation lists 15 businesses!!! I spoke to one but said they couldn't do anything about it if it was them anyway.

    I've just spoke to the court and they say I have CCJ against my name!!!!

    Email I had from oct 20th goes like this.

    then next thing I have is judgment for claimant on 20th November from court.

    I'm useless at this legal stuff and I feel it is really unfair that the can distress someone so much, can they send bailiffs round?

    The letter from minster bay watch instructing you to ignore is important, and it also shows the combined incompetence of minster bay watch, and Gladstones, but before we get carried away, check and double check that the county court judgement relates to the minster bay watch parking charge notice

    Absolutely. Double check all details with the court

    While they told you to ignore, did you get a CLAIM FORM through the post? That should set alarm bells rinigng, and prompt you to chase.

    You should get MB to agree to a Set aside by consent, AND an order to dismiss the claim, ALL AT THEIR COST - as they instructed you to do nothing.
  • As them to do what post 9 says. Tell them that if they won't then you will apply to set aside, will apply for costs, and you will issue a claim against them for damages for harassment and data protection breach.


    Are you sure you only had that email and nothing else? Was a claim form served on you? If it was and you ignored it, obeying the email, you can still apply to set aside so don't worry. But you need to act fast.

    The reason for asking who the car park owner is, is that they will be jointly liable for the actions of their agents, ie the parking company.
    If this is a major or a large company then, in my opinion they should know better and they should be named on any action you may need to take against the PPC as well, plus you may get a result if the PPC disappears/phoenixes ( as what used to happen with clamper's) as you will be able to claim against the landowner who would have been acting as principal.
    At the very least you will be able to give the landowner a big headache.
