Contact Minster and tell them about their "error" first and ask them to agree a set aside "with consent" or you will apply for a "without consent" set-aside with adverse costs.
Also write to the DVLA and ask them to investigate this abuse of the Keeper database as Minster clearly are not checking the details. Get the DVLA to investigate the failure in Minster's systems and point out that the BPA can't have cleared them as the mistake should not happen. Suggest that Minster be sanctioned until they can prove their systems are robust.This is a system account and does not represent a real person. okay spent hours today trying to contact people. E-mailed Minster no answer from Friday's e-mails. {edit just got this reply}.

E-mailed gladstones and done online enquiry form which says will reply within 28 days.
Spoke to DVLA and they said Minster had got details for both cars!! (that's dodgy yes?) Got address to write in and complain.
Spoke to court who just sent me the same documents N244.
So guess only option is to pay the £255 and fill out form N244, so any help with that would be appreciated!
Court Judgement for claimant was 20th nov and last gladstone letter was 1st dec, so running out of time!0 -
BTW had no notice of court hearing, so could not defend it as no knowledge and Minster had admitting an error by e-mail.0

So nothing was served on you? The court serves the claim, so you need to find out what address was on it. It's all very odd. Okay done all mentioned in above posts and recieved a call from Gladstone but just a receptionist! Said would call but nothing yet! Emailed Minster 4 times got reply they are investigating it. So dead end till they do something. I’m worried about running out of time to do anything.0 -

All I got was judgement for claimant from court No defendant pack!0 -
Stop using the phone! Everything in writing so you have a paper trail.
Did you ever get a county court claim form through the post? Probably around the beginning of November, perhaps slightly earlier. Once a claim is issued, you have 14 days to acknowlege the claim, after which they can apply for judgment in default if you dont respond... which means the claim was issued in the first week of November at the latest... a very short space of time after the Oct 20th email!!
You really need to answer this, so you get the right advice.0 -

You will not have got any notice of a court date unbless you got a claim form through the post, then acknowledged it in time, and then submitted a defence in time.0 -
