  • Hi, i successfully got a letter back from capital one offering the full amount i asked for after only 3 weeks, fantastic i thought i accepted and sent the letter back accepting their offer. I have now checked my account online and they have credited my account, great!! But have also debited my account for £98.45 listed also as an adjustment for overdraft cash advance???? Can anyone help and advise me what to do next as i'm rather miffed that they've given me £195 in one hand and took £98 out of the other!!! Are they allowed to do this???

I suggest you call them to explain why the unrecognised charge of £98.45 has been debited from your account.

If it's a mistake, they will probably immediately rectify the error.

If it's not a mistake, they should be able to explain the charge and why you incurred it. That will hopefully be enough info to help you avoid incurring this type of charge in future. :)

Sounds to me like you have probaby withdrawn cash at some time against the card (which can include buying foreign currency, and a few other odd types of transaction not always instantly recognisable as a cash advance), but a call to them will clarify everything, I'm sure.

  • Hi everyone, right I'm giving this a go. I had a card with Lloyds TSB from about 1991 to 2007. I have no statements left but fortunately do have a note of the card number. Reckon they probably were charging me £35 judging by the amount I paid when I closed the card. Sending SAR today and keeping everything crossed. Even if it turns out to be a couple of hundred pounds that is not peanuts to me and so thank you to everyone contributing here for giving me the confidence to give it a go.

    Best wishes, MG

  • Thanks Premier, called them and asked what the charge was. I was told that the debit is actually a cheque that is being sent to me, why i don't know because in the offer they said they would credit my account. So it seems half of the money has been paid off my account and the other in the form of this cheque. Seems wierd, would have liked it to gone off my account then its almost paid off so now got to wait 7 - 10 working days to receive it and then a further 3 days to clear then pay it back to them!!!!

Wow! I put in a request to Cap One in June and had a small offer that didn't even add up to the difference of the £20 / £12 then 2 letters saying it will be 4 weeks to investigate again. Not sure why it takes 4 weeks, then another 4 weeks when they had all the detail to give me when they sent my charges, then did original investigation. Congrats BTW

Surely they are not justifying the charge on the account of almost £100 based on them sending you a cheque to reimburse you the money they obviously agree they charged your account incorrectly in the first instance?

Yes they do usually first use any money they refund to lower the amount of borrowing you have with the company.
If you had requested, and they agreed, not for them to do this but send you the money, then this could arguably be considered a cash advance ... but it appears you didn't ask them to so you haven't requested a cash advance.

If the reason for the cheque is to cover the balance they still owe you after clearing your current amount owed, it's still not a cash advance, but money they are refunding you for their earlier errors. i.e it is money they agreed they owe you.

Time to raise another complaint I suggest, demanding the removal or refund of the new charge they have apparently incorrectly imposed on you.

If you don't have the account number, you probably don't have the details of the individual charges incurred either.

Follow the credit card reclaiming guide to request these, giving any information you can to help the company identify you / your old account. e.g. name, address(es) (at time of account holding), approximate dates of opening and closing account, etc.

Wrote to MINT (part of RBS) requesting refund of £284 in late payment charges on my MINT credit card which includes £72 interest going back over six years

Received their response today saying they are willing to offer £60 as refund of the difference in charges (£12 post 2006 and £20 pre) which includes interest

I think this is only their first offer and will probably reject this in the hope of them upping their offer

Any thoughts from anyone who has had previous experience in dealing with MINT or RBS credit card service?

Update on my MINT claim - received letter 02/09/10 upping their offer from £60 to £228.96 which represents £212 late fees x 8% interest

I claimed £212 late fees x 8% interest from date of fee being applied which came to £284.18

That leaves a £55.22 difference between what I claimed and what they are offering

Any advice / views on whether I should take the money now or fight on for a further £55.22?

    Appreciate any thoughts
