Hi all,
I have recently received a letter in response to my credit card charges reclaim.
My total charges, inclusive of both £25 & £12 was £1,086.00 with interest added totalled £1,393.85. I wrote asking for this money back and received a response saying my complaint will be looked in to and i would receive a reply by the end of September. I saw this as diversionary tactics so proceeded with the threat of court action.
I have since received a letter offering £664 as a gesture of goodwill and that they feel the charges were fair etc... they also state at the bottom of this letter that this is the final response they will give and should I still not be happy to refer to the ombudsman.
Not that I am greedy but the interest alone was £300+ on my charges so I feel this is a pityful offer...
Where do I go from here? Any suggestions as I recall somewhere about a letter accepting the offer "without Prejudice" but cant seem to find anywhere? Also should I no proceed with court action etc?

Paddy it's up you whether you accept the offer or not. Personally I have refused all the first offers I was sent and although they always tend to say final offer most have come back with higher (still waiting on a few). Could write to them saying that you accept their offer as a partial settlement but still expect the rest of the money to be refunded to you. I would at least expect the charges to be returned. It does drag it on a little more but I've just settled with the first one at all my charges + 8% interest + a 'goodwill payment' towards the contractual - which is not all I asked for but cleared my balance with a little bit left over so am happy with it.0 -

Refer to the article. It explains your options which are essentially to ask the FOS to review the claim (as already suggested by the credit card company) or take the matter to court as you have threatened.
My suggestion would be to first go to the FOS if you are not happy with the proposed resolution because (a) it is free of charge, (b) you can always reject the resolution proposed by the FOS and take the matter to court anyway if you don't agree with their proposal (you can't do it the other way round) and (c) court action should only be considered as a last resort."Now to trolling as a concept. .... I am ready to send the letter asking for the cc charges/intereset to Halifax - can anyone confirm the address/what department i send to pls? I have an address on the statement do i use that? Thanks0

In the last week i've had final no's from both Aqua and Virgin Credit Card. I sent the LBA to each of them at the back end of last week (after Aqua had sent their letter to my old address for the 3rd time) and 2 days before Virgin sent their final response. Do I hang fire before going to the FOS as people seem to get different responses from the CC companies when this happens and some just go to FOS or MCOL anyway. I'd obviously rather not go down either route but MBNA have point blank refused to discuss anything and told me to speak to the FOS.
Aqua are a shambles. I've never had a statement for 4 months, no correspondence as its all gone to the wrong address despite me writing to them with a new address (they manage to send a copy of charges to my new one) then ringing the customer services to change it weeks ago and having to go back to them again on Friday. I've never known a more unproffesional organisation in my life. I've missed a payment that I didn't realise and as i've never had a statement despite asking for them I didn't know where I was with my card. Continued to pay my normal payment each month thereafter but as i'd gone over the limit (and didn't know) I was getting hit each month for not paying enough and going over the limit. They put me on a payment plan I knew nothing about and getting an answer out of anyone in customer service was a joke. Eventually spoke to someone on Friday who managed to get the system changes again (for address) and tell me where I was with card. Seems i've been paying more than they wanted on the payment plan, but as I didn't even know I was on one I was furious. Wrote to MINT (part of RBS) requesting refund of £284 in late payment charges on my MINT credit card which includes £72 interest going back over six years
Received their response today saying they are willing to offer £60 as refund of the difference in charges (£12 post 2006 and £20 pre) which includes interest
I think this is only their first offer and will probably reject this in the hope of them upping their offer
Any thoughts from anyone who has had previous experience in dealing with MINT or RBS credit card service?0 -

Reject their offer and they will come back with a revised offer for the lot about 14 days later. This is standard Mint tactics.Wage Day Advance, Quick Quid, Pounds to Pocket and Pounds Till Payday....i'm after you0
