  • I'm trying to help a friend - she currently has a credit card with Natwest, the balance was £54. She was living with family, but due to family circumstances she had to move out. She was NFA for a while, so couldnt change her address with them - whenever she asked if there was post, they said there wasn't anything until late December when they brought round three letters.
    The letters turned out to be statements - showing that she had missed a payment (she thought she'd cleared the £54) and showing the interest and non-payment fees. Now she owes £454. Which she's willing to pay off, but would like to be able to claim back the fees if possible.
    Is there a way to get the fees knocked off before she pays the balance? or do you have to pay it off first and then re-claim it??

    "You can go back six years in England and Wales or five years in Scotland; these time periods are limited by law."

    is that correct?

    You can reclaim back to 1995 based on UTCCR 1999 but expect to have to sue them in court for the money

  • Hi everybody,made a claim from hsbc with my credit card ppi,my basis was i wasn't told it was optional, etc. They got back to me and said they can't uphold my claim for the following reasons:
    1. They provided me with information leaflets etc for me to read.
    2.There was a cooling off period in which I could have cancelled the ppi if I wasn't happy
    3.It was reflected on my monthly statement that they have been charging the PPI
    By the way I opened this account in 2003.

    It was probably my fault, I did notice that they have been charging me with this ppi but I thought it was just part of the charges for having a credit card(This was my very 1st credit card), it wasn't just recently that I learned about this PPI reclaiming stuff that I thought I should claim. Any advice on this?

    Its time a took Halifax credit cards to court over charges.
    However i am stuck on the POC (Particulars of claim). Looking on here its only a few sentences yet on another sight its paragraphs of technical jargon yet none specific to Halifax. Can anyone advice on the POC

    Hi all I need some help sent to letters to capital one trying to claim £700 odd they replied with we're only offering you £192 + £23 interest. I've not excepted and sent a 2rn letter to which i haven't recieved a reply. I have now sent all the info to the ombudsman but i've read something about them not replying to my 2rd letter makes me win but not auto payout i'm a bit confused any help would be most greatful. Kind regards sarah

    Afternoon all!

    After sending my 2nd letter to Cap One trying to reclaim £292 in charges plus interest of £103.30 so £395.30 in total. I have received a reply from them stating they will settle for £43.51. How do I now say thanks for the £43.51 But I still want the rest of the money does anyone know where I can get a template letter from to send.

    Decline it and state you will give them one last chance before suing them in court which will incur further costs on their part for them to settle.

  • Hi I have approached the Royal Bank of Scotland and asked them for just over £300 in charges but that was the full amount of the over charge rather than taking in to account a basic £12 charge. I therefore did not expect them to pay it really and felt that half that amount was a true reflection of what was owed. They have offered me £138 and I am happy with that as I feel it is fair. They have also returned my cheque for £10 and have been prompt and polite throughout. The only thing that as I am paying off the card and still have a balance outstanding they have told me they will be putting that amount against the sum owed. Can they do that? I was going to tell them to do it anyway but I would rather have had the choice. I have not yet sent the acceptance letter so would like to hear anybody elses thoughts on this

    Yes they can which is why I would pursue the full amount and accept the part repayment of the amount. It will reduce the debt even further.
