    as far as I am aware, if you have had no contact with the company, the debt (contract) cannot be enforced after 6 years.

    Hi,

    Newbie here.
    On the 24th November, I sent a template letter to Barclay Card requesting details of my charges for the past 6 years. I got them on Wednesday 6th January 2010, but only from June 2006. Can anyone help me sort this out? Also, I don't use a credit card anymore and don't want to have any. If Barclay Card decide they want to close my account, what happens if I haven't paid the outstanding amount? I already pay it monthly at the moment.

    Any help would be appreciated.

    I need some guidance please, I am having help from CAB for debts which most have accepted my offers, I am going to try to claim back charges but do not ant to pay £10 for the statements, is it worth stating financial hardship to see if they send me the details without coughing up the tenner?

    Apologies for the incredibly silly question but am I right to assume that the recent result in the bank charges case has no bearing on claiming back charges from credit cards? Only just received my list of charges, so am keen to follow up with my claim letters.

    it has no effect whatsoever.

    Contact them again, they have failed to comply with the regulations and remind them of their obligations, I have found Barclay Card less than helpful so you need to keep on at them, be firm give them one more chance then go to the banking regulators.

    Dont get hung up on this issue, I have numerous credit cards and have been dealing with them all, as I am unsure of your situation this is what I would do: If you cant pay them with interest send a budget form, make an offer with them holding interest. If you can switch accounts to one offering a 0% balance transfer if not dont worry, as you have sent thema budget plan if they took it to court the judge would throw it out because you have made an offer that you can reasonably afford.

    I pay £1 per month and am trying to get my charges back - I work on the theory that if they had not charged me so much I might have been more able to pay in the first place!.

    If they close the account they will send it to debt collection this is nothing to worry about, re send the budget form - whatever happens stick to claiming back what is yours.
  • Bit of good news courtesy of Cap One, after dismissing their first offer of £120, threatened Court action via the templates and got a full refund of £856!, Cheque recieved

    MBNA claimed for £536, got first offer of £130....letter in the post.

    I have a BOS Preference Account which acts like a credit account. IE you have a credit limit, spend money, then pay it back each month. Is this a Bank Account or Credit Account for reclaiming purposes?
