Hi - hope this is the right place to pose this question:
I had a credit card with Lloyds which I defaulted on in 2005. I eventually agreed a reduced repayment through a DC agency.
Recently, I wrote to both the DC and Lloyds asking for a copy of my original credit agreement as a starting point in hopefully reclaiming some of the charges. Have heard nothing from Lloyds yet, but the DC replied saying that LLoyds no longer holds a copy, as the commencement date of the agreement was in October 2000, thus falling outside of the 6 year time frame. I thought that if I had been making repayments up to the time at which I defaulted in 2005, then this meant that it fell within the 6 year time limit. Are they correct or just trying to discourage me? Any thoughts gratefully received.

hi there i tried to reclaim charges on an old marbles credit card- it wassettled in Nov 2005 but believe me there were plenty of charges! i sent my letter off requesting statements but got a reply today from HALIFAX (who i have had no dealings with EVER) telephones the number on the letter and after speaking to five different departments i was told to telephone marbles. I was gven the no. and telephoned only to be told that the account was closed a "long time ago and there are no records of it so they can be of no further help" what do i do now?0

Hi Beemamad, just wanted to share with you my experience which I thought you might appreciate as it was very similiar to your predicament, althought I appreciate mine was with a different financial organisation, Abbey MBNA.
I sent letter asking for full amount of charges. They responded with partial offer of just refunding the difference and enclosed a cheque for this amount. I banked the cheque and sent further letter thanking them for a partial payment which I accepted "without prejudice" (important you put this in your letter) but that I DID NOT accept their offer and that I was seeking the full amount of FOS procedure will follow. 2 weeks later I receive another cheque for full amount that I was seeking with a letter stating goodwill gesture and that fees are fair....blah, blah, blah.

Thanks, this was a great help as i phoned LLoyds and harassed them until they eventually issued one cheque in response to my second letter, then reissued the first cheque - total of £1139.45. :T0 -

I requested a list of charges for my RBS Visa and they sent a spreasheet detailing everything I'd apparently been charged.
My sticking point is that it staes that before 2006, the default charges were £15 - I don't think this is correct, I'm certain-ish it was £20.
I've searched the net etc, but can't find any info. Does anyone else happen to know or remember?
I've stated natwest too because as far as I'm aware they're one in the same, and my response was on natwest headed paper.

I've got my answer for my above post, prior to the OFT decison the default charges were £20 but £15 for students and it was a student card I had. So thats fine.
Another question though - a relative of mine used to have a barclaycard, and I know you can claim on closed accounts [we have the number and everything] - does anyone know if Barclays charge you for your default charge list? RBS didn't charge me, they returned my cheque, I'm just wondering if we could give Barclays a call and ask for the list as opposed going through the letter stage.

Got my statements from Capital One on Friday 24th April, after filing a complaint with the FOS same day. Does anybody know if Capital One were charging more than 12 pounds for late payments between 2004-2006?0

Yes, capital one were charging £20 until the OFT decision in 2006! I have some of my old statements and checked.
I'm still waiting for them to respond, and I requested the information 4 weeks ago - they so drag their heels!0 -
I have just had my first response from the Halifax stating they will repay £217 from my £1008 claim (just the difference between the £12 fee and not any interest). My credit card is now just a debt and they say they will pay this amount straight off the debt. Should I settle at this point or send the next letter requesting it be looked at again. Just wondering if others have experience they could help with!0

a bit of advice sought please....
How far back can you claim?
When the claims first started to be reported on a few years back i spent a week going through my 15 or so accounts (going back 10 years) looking at every statement and cataloguing the charges I saw as being valid points for a claim. - i'm not sure i still have this info and don't want to go through the experience again as my wife has since 'filed' the old statements in the round corner filing cabinet that gets picked up by the council every fortnight :rolleyes:
If I did think ahead (need to check on my other PC) and save the info, brilliant. If not, is there an easier way to find out how many charges i can claim for, by maybe asking the bank to identify what and when i've been charged?
Will they be honest and admit such info?
This applies to both credit cards and current accounts by the way.
Any other info you need? Some of the accounts I still have, although many I don't - I don't have connection to a couple.
I've got many 'parachute' accounts already set-up in case any of the companies take their bat and ball home with me.
