hi everyone
had some successes reclaiming unfair charges and just wondered if any one cold advise on the following.
like so many others out there i've had hundreds of pounds worth of unfair charges and fallen into arrears on more than one card as a result. i would guess i've had adverse comments on my credit files. i would argue that without those charges i would have been able to maintain all my commitments and wondered if the companys are reimbursing these fees can i also force them to repair my credit files as well.
any comments would be appreciated.0 -
Whilst you can go for the reimbursement of the unlawful charges !!!! You could try and pressure them into sorting repairing your credit file but to be honest I dont hold out much hope Im afraid.
When I eventually win with all my CC's, I for one will be writing to each to ask them to repair my credit file but I doubt if I will succeed. You gotta try though hey.

I have had a letter back from mbna with a big speil saying there charges are fair blah blah blah and as a gesture of goodwill we will offer you £55 which they have paid straight into my account.
I do not want to accept this offer as I asked for £259 + £57 odds interest.
Which template letter should I go onto next as I am not sure what to write back now.

I had the same response to claims on 2 MBNA cc. Send the 2nd template letter on the reclaims thread stating how much you are claiming and ignore the amount they have already paid. You should get the full amount and interest eventually. I did with both accounts. They told me that as a goodwill gesture they would pay the figure requested by me!!
Don't give up. You tell them what you want and don't be put off.

Write another letter (use the template one again, but modift it slight to your purpose) thanking them for the payment which you accept as a part payment for the sum you are seeking and continue requesting the remainder and give them time limits to adhere to this or you will see take the matter further and complain to the FOS/Court.
I done exactly the same (used the 2nd letter I think, slighty modified) and was successful.
Keep going and dont give up.If you see a penny, pick it up, all day long you'll have good luck !!!!!!0 -

Thank you so much for your quick responses. I am really pleased to hear that you both got your money back so I think I will defo continue with my claim.
I thought £55 was a bit of a cheek actually and the fact they paid it into my account without asking and if I would even accept it.
I cant see a template two only the one to put on hold or the court one but I will just amend the first template as you suggested.
I really need every penny I can get in helping to pay off my debts.
I will let you know how I get on.

I will be trying to get them to repair my CRA report as well and can imagine the response I will get

JoAnnI have just had my first response from the Halifax stating they will repay £217 from my £1008 claim (just the difference between the £12 fee and not any interest). My credit card is now just a debt and they say they will pay this amount straight off the debt. Should I settle at this point or send the next letter requesting it be looked at again. Just wondering if others have experience they could help with!
Do not accept their offer, just fire off a second letter thanking them for GOGW but tell them you want the full amount with interest and if they havent sorted it in 14 days you'll "County Court" 'em.
i know it sounds daunting and you're only little you against a multi million pound bank but it works. i've had two successes both made low initial offers and then stumped up full amount and interest after second letter.
i've also got three others who made initial offers and i've writen back with the thanks but no thanks letter.

I had a capital one credit card 5 years ago, Now the account is no longer in use as it was included in my trust deed. I am now discharged from my trust deed.
The question is can I now claim back the £198 of charges the applied to my account 3 years ago?
