    I requested statements from Capital One and eventually they came!!! Requested refund of charges - was offered difference between £20 fee and £12 fee of £232 plus £20 interest.
    Sent second letter refusing this offer and asking for full amount.
    Received a second letter from Capital One offering £252 saying final respone.
    03/03 Filed MCOL (was terrified!!)
    21/03 Received a letter from Capital One saying they will refund £1304 as a goodwill gesture :beer: :beer: :beer: :beer: :beer: :beer: :beer:
    That means card is almost clear (will be by the end of the month!) yipppppppppppppeeeeeeeeee:j :j :j

    Can anyone definitively answer whether or not you can insist on any successful claims be repaid to you in the form of a cheque or bacs repayment?

    The account had been closed some three/four years ago, but I took a punt anyway. Sent the first letter from Martin's template on 6th Feb, got a confirmation of receipt a couple of weeks following that. Picked up a letter dated 19th March offering a goodwill payment into a "chosen bank account" of the full amount :-)

    Amazing - two charges now reclaimed (including my Egg PPI refund) totalling more than a grand and all for the cost of two letters printed and two recorded deliveries.

    Amount paid: £201.93

    I wrote to them asking for a refund of £172 + interest, total £201.93. They wrote back stating they would not be paying anything over the difference between £12 and £25 (for which I had been charged 4 times) and offered me £52. They stated they would not pay any interest and that I had 2 weeks to accept their offer or, basically, I could forget it!

    I wrote back stating that I was not satisfied and threatened to take them to court unless they paid up in 2 weeks.

    They wrote back stating they would get customer services to give me a call.

    A week later (having received no call), I received a letter confirming they had credited my account the full £201.93.

    Result!

    I followed the process using the letter templates, very easy.

    17 Feb - asked for list of charges (didn't send £10!)
    20 Feb - detailed list received
    26 Feb - requested repayment of £768 + £189.69 interest
    3 Mar - offer of £207.36 received
    6 Mar - refused offer, sent 2nd letter
    18 Mar - offer of £768 + £61.44 interest received
    24 Mar - accepted £829.44

    RESULT!:beer:

  • Used martins template letter to recalim 3 x £12 from barclaycard.

    Sent the letter Monday afternoon.

    Just checked my online account and the £36 has been credited !!
    Took me about 15 mins to do the letter and what a result !!!!

    Totalled up charges + interest £305.05

    1st request for £303.05 sent 9th March 2009

    Letter received stating would offer £61 + £6.37

    2nd letter sent 23rd March 2009 accepting initial £67.37 'without prejudice' and please can I have rest of claim money or I will proceed to Court

    Letter today 26th March - full refund of £305.05 agreed promised to credit account within 14 days - RESULT and very rapid at that!!!!!!

    Amount they paid: 68.56
    The story: My wife's credit card, after getting list of charges and cheque for £10 returned as "we do not charge for this service" I replied with the template second letter on 5th March asking for all charges back (even though they were all the £12 "maximum allowable")
    Letter received 12th March offering £68.56 as a goodwill gesture!
    Result!
    Interestingly though, I claimed charges back on my own HSBC card at the same time, and followed the same path of replying asking for the return of these charges (£260 + Interest). On the same day I got the settlement offer from HSBC "Service Failure Resolutions" Department, I also received a reply to my credit card reclaim, using the exact same phrases ( I guess copy and paste is everywhere now) except that this one contains no offer and is basically a "get lost" reply. I will, naturally, pursue this with great vim and vigour and take great pleasure in receiving this particular refund. I like it when they struggle a bit.
    Update 26/03/09
    Received letter from HSBC Service Resolutions regarding my claim for 260 + interest, previously rejected, after I sent a second letter threatening Court Action within 14 days (template letter) if no satisfactory response received. Received offer of £416 (more than I asked for) as a "goodwill gesture". That is the correct response, I think, for an organisation which has been caught with its' "fingers in the till".
    And I really don't care if they maintain that their charges are "fair and reasonable" - as the OFT evidently disagrees and so do I. As soon as possible, I will be voting with my feet to walk away from HSBC. I wonder how their business model will look WITHOUT customers? Considering the lengths they go to to attract new customers with special offers, it is quite astonishing how they treat their existing customers. Dysfunctional!

    I had heard about the reclaiming charges but thought the whole process was fart too complex. However I came onto this site in January 09. Sent my first letter 21.01.09, received the request for the fee. They then sent me photocopies of all statements last week. I thought what a pain, however, I sat down itemised the charges, used the online interest calculater and yesterday received a credit to my account of £740.00, this was only £80.00 short of my claim. I am amazed and thank you for the help on this site. Anyone considering I can only advise go for it!!!
