  • Received some updates today - our buyers buyer now seems satisfied and are just waiting on contracts to sign which are being sent out. Our buyers still don’t have all their searches back but are on with reviewing our responses to enquiries so hopefully they are almost there. We are yet to receive responses to our enquiries but hoping that we may get those early next week. I will take any small glimmer of hope at this moment in time 😜 x

    Received some updates today - our buyers buyer now seems satisfied and are just waiting on contracts to sign which are being sent out. Our buyers still don’t have all their searches back but are on with reviewing our responses to enquiries so hopefully they are almost there. We are yet to receive responses to our enquiries but hoping that we may get those early next week. I will take any small glimmer of hope at this moment in time 😜 x
    That sounds like very positive news and great progress. Hope you get those responses soon and things can move forward soon. 
  • So our onward purchase is literally hanging by a thread due to either, our buyer’s solicitor not sending the Santander the indemnity policy document or Santander not picking up the document when it was sent. We were all set to exchange last week when suddenly, it came to light that Santander had not received the document. It was resent last Friday but a week on we have heard nothing!!!! Everyday we are asking for updates, we get told it’s been escalated and we’ll hear in 24 hrs… still nothing… oh might be another 48 hrs!!! There is literally nothing left for us to do but I have got to the point where I really feel that our buyer’s solicitor has really messed up and is not being truthful with either our buyer or our EA, who has also worked very hard pushing things for us. Our vendor is not patient as I’ve said in previous threads. Already I face paying three lots of conveyancing bills as our main residence fell through earlier in the process. We will owe the best chunk of £5K!!!! Apart from the obvious things of rattling cages and banging on doors, is there anything else I can do???? I’m feeling pretty rubbish due to us holding everyone up through no fault of our own!!!! Any advice welcome!!!
    Really sorry things aren’t going as expected, it’s so frustrating as you have no clue who to
    believe. What has your EA said? Have they spoken to your buyer to find out why it’s taking so long? Hopefully you will get some good news soon 🤞x
    I have since had an update and it appears Santander want to see another copy of the plans showing the PRoW which runs in a straight line within but on the very southern edge of the boundary of the property. All this was discussed and settled during the enquiry process or so I thought. Not sure why this would get to exchange and then suddenly be brought up again. Surely this should have been resolved with the lender on valuation. Both our EA, Conveyancer and buyer have been very proactive about trying to sort this although I do think our buyer’s conveyancer has been a little slack with things.

    I have exchanged on both  :) At long last. I need to break the chain for a few days but at least it is all happening for certain now. Very relieved. It's daunting because it is a higher mortgage, but certainly a good move. Thank you for keeping me sane (I haven't gone yet so will be back!)
    If anyone has sellers pull out, buyers pull out and have to jump through every hoop imaginable...it is possible....eventually

    It does sound like an issue with the buyers conveyancer as they should have included all information on PRoW in the certificate of title for the lender. The lender is usually guided by the conveyancer, so perhaps they have flagged it for the lenders consideration? If everything else is sorted, hopefully it won’t take too long to resolve x

    Joining the party. 

    Our flat sold in March and we waited ten weeks for the owners of a home we found (and loved) to find somewhere. When it became apparent they weren’t able to, we managed to find another, equally as fantastic home, with the bonus of being chain-free. 

    That was eight weeks ago and for a period we were flying but since solicitor searches came back three weeks ago, and my solicitor raised enquiries, we’ve hit a brick wall. 

    I’ve chased and my solicitor has chased, but we are seemingly stuck waiting for the council to give responses to the sellers solicitor. Is there anything we can do realistically other than contacting he estate agent and my solicitor contacting the sellers solicitor? 

    Meanwhile the clock is ticking down on our deadline of beating the next SDLT deadline of the end of September - we already missed the first with the first sellers messing us about.

    All the while, our buyers - an investor - is sitting waiting and no doubt growing increasingly frustrated at the six month drawn out process for them.

    It sounds like the solicitors have been making good progress but the local authority searches are causing a delay. Have you checked on the council website to see what their estimated times are. It can vary depending on authority. Once the search responses come back the solicitor will have to go through them and raise any further enquiries.

    I have read on here of posters contacting or checking with the authority as well to get an update so not sure if that would be any help. The EA sales progressor should be chasing too so hopefully they can give you an update. 

    I hope things start moving again soon.

    1st July - Extra documents requested and uploaded by Broker
    9th July - Proof of Deposit requested and uploaded by Broker
    12 July - Searches applied for
    19th July - Problem with Proof of Deposit upload - reuploaded by Broker with narrative
    19th July - Survey carried out
    20th July - Offer issued - checked and confirmed by Broker

    So I had my first proper cry since we started this process (we're on week 10, so I think I've done pretty well!) After the top of the chain insisting they wouldn't be ready to talk exchange dates until September at the earliest, we had an email from the estate agents saying they had factored in the 2.5k stamp duty saving into their purchase so they have to complete by then. 

    This causes a huge problem for us because we're still waiting on some work to be completed and inspected on our house before we can exchange, which won't be done for another 2 weeks at least, and we're away for a lot of September due to work/family. Also, we had communicated that ideally we would want to exchange and complete in different months so that we avoid a rent and mortgage overlap. Obviously, we've budgeted for this if necessary, but after causing delays themselves the top of the chain were essentially saying we needed to spend an extra 1.5k so that everyone else can save!

    All of this gets me in a massive panic, and after a teary conversation with my partner we decide to call the estate agents and see if there's a way we can mitigate our additional costs while still making the deadline work. Turns out he doesn't think it's worth even talking about as there are still things outstanding throughout the chain and there's no guarantee anyone will meet the Sep completion deadline.

    Such a stress over nothing in the end! Gonna need some chocolate this evening to recover!
