    Hello all,

    I have recently paid up my mortgage and now mortgage free. Do I now need to register the Land Registry that I am now the owner? not quite sure what to do regarding deeds etc...

    No. If it’s registered you are the legal owner. And if the lender has discharged the mortgage it will have been removed from the register.

  • Hello, we bought a house in June 2023 and the transfer of ownership is still not showing on LandRegistry. How can I find out why is there  a delay?

    Ask your conveyancer to check online re progress - it may still be waiting to be processed but they can confirm date submitted and whether waiting or otherwise. Your ownership is protected once it’s been submitted

    I received a property alert this morning.  I am a lessee in a small block of flats; tracking the alert by title number shows the alert is about the freehold title.

    I can think of several scenarios (maybe there are others):
    the freehold is being sold (so the lessees should get first refusal?)
    the freehold is being transferred to another company (is this the same as a sale?)
    the freehold is being mortgaged 
    an existing mortgage is being redeemed.

    Should I be concerned about exactly what is going on?  How can I find out?

    A grant of a new lease would also be a transaction on the freehold title.

    In short, no, it doesn't mean it's something you ought to be concerned about, if you're not the freeholder.

    For most leaseholders it’s their leasehold tenure, not the freehold, you’d have an alert for. Getting alerts for things that don’t directly concern you seems unnecessary as the alert service is to help prevent fraud so for a leaseholder that means their leasehold is the one to keep an eye on. 
    If you want to know what the application is for either contact the applicant and ask but they may not be willing to tell you as you’re not their client/involved. 
    Or apply for a non priority search (form OS3) which will reveal the type of application it is and the parties involved eg deed of variation re lease X made between landlord and leaseholder of X. Postal OS3 and £7

    Sadly, my wife passed away at the end of December. We held title to our home as Tenants in Common. I will not be selling and I am the sole beneficiary of her estate. Am I correct in thinking that submission of Form DJP plus a copy of a certified Death Certificate is all that is needed? Probate won't be needed for any other purpose.

    So sorry to read of your loss. Form DJP and cc death certificate will update the register re her death. That’s correct. 
    However you refer to yourselves as TIC so if the register refers to a form A restriction then you should also apply to cancel it using forms RX3 and ST5 
    See PG 6 section 7 for guidance.

    Home owned tenants in common, (myself owning the larger share.)
    Ex-partner has passed away.
    Now need to sell the home, but letters of administration have not come through yet. 
    The ex-partners family are very hostile and will not communicate, do not even know if they have applied for letters of administration yet as their solicitor is refusing to reply to my solicitor. 
    This is obviously delaying the sale, infact brought it to a complete stop as my solicitor says they can not continue with the sale until the letters of administration are received. 
    Is this correct as I am getting conflicting advice. 
    I have also been told from another source that the sale could still go again so long as 2 trustees were appointed.
    Are you able to advise please?
