    If it’s an application to change the lender’s address then it wouldn’t usually be an issue as it’s not adversarial but simply a positive update to the register. The pre-completion search would reveal what it was but very much your solicitor/lender decision whether to complete or not. 
    If they won’t and the application is preventing a linked/dependent transaction from completing then they need to ask us to expedite it

    The bank won’t so I’d get your solicitor to do it as they need to provide documentary evidence of the dependent transaction eg memorandum of sale

    12 years ago my mother died and left her house 50/50 between myself and brother. My husband and I opted to buy my brothers share by way of a mortgage and using my half of the property as a deposit. At the time for various reasons I chose not to be on the mortgage and gifted my 50% to my husband. The mortgage company insisted on me signing a deed of trust (I think) saying that I was giving up all claim on the property and my right to live there. I had legal advice at the time and chose to go ahead. My husband insisted to me that once the mortgage was paid off that I was to be put back onto the deeds. The mortgage will be paid off in full within the next 8 weeks and my husband wants to make good on his promise and add me back onto the deeds as soon as the mortgage is gone. Is this something we have to do via a solicitor because of the deed of trust I signed or can we do it ourselves with just the TR1 form?

    There’s no requirement to use a solicitor but we’d always recommend that you do as they do more than just complete the forms/application and can crucially advise you on the trust and how it can be brought to an end. 
    AP1, TR1 and ID1/ID3 x 2 are the registration forms/requirements as you already know it seems. They will enable your husband to transfer it to himself plus you once the mortgage (charge) has been removed

    Hi, thanks for all your help earlier. I was asking about the seller who was unaware they didn’t own part of the garden. The solicitor had either forgotten to register additional land when they purchased the house or there was an issue with land registry transfer form. Please could you let me know roughly how long it should take for land registry to confirm whether or not an application to transfer names on the additional land was ever requested. Vendors solicitors have requested this approx 3 weeks ago (so they say)? Thank you

    I'm in the process of selling a property, although it should have been registered when we purchased 13 years ago, this was never completed by our solicitors, so we now have to complete first registration before the sale can proceed, this is underway and we have confirmation that the case has been expedited, however the registry or solicitor can't give any idea of a timescale, can anyone tell me in average, how long an expedited first registration may take? I'm concerned that our buyer may pull out and also our new property vendor may get cold feet and put the property back on the market.
    Is it at all possible if both buyer and seller are in agreement, to sell an unregistered property, my conveyancer says no, but I'm unsure??
    Expedition means that generally speaking it’s processed within 2 weeks. Everything then hinges on it being in order of course
    It is possible, remember that’s how it always used to happen, but the decision is often for the mortgage lender and not the seller/buyer to make. Many say No depending on mortgage product involved 
    Ok, thanks for the info, there is no mortgage company involved as it is a "cash "purchase, but I think we are nearly there with the land registry now.

    Thanks, unfortunately no enquiry or title number has been given to us by the vendor. Perhaps our solicitor has this information I don’t know.

    My solicitor believe The filed plan is incorrect regarding the access way to the property. It seems like a simple change. The seller solicitor arrange for the land registry

    Expedition reduces the wait time before it’s processed. Usually to less than 2 weeks 
    In this case we’ve written to the conveyancer asking them for more to enable us to move matters on. That was on 30th April and we await their reply.

    please let me know wether you need two weeks from the day you get the answers needed. or should be less considering the case has already started ?

    2 weeks only applies to the request to expedite part. Thereafter next steps are asap
