  • At the beginning of July, we paid off the small amount left on our mortgage and were notified by our lender that they had applied to have the charge removed from the register. We are now assisting one of our children to buy their first flat by taking out a mortgage with a different lender, but we can't proceed until the old charge has been lifted. 

    Would you be able to tell me what is happening please? The title number is SY192221.    
    The charge was removed on 15th July.

    The creditor is not shown in the search result, only the property owners names.

  • hello, we're hoping to purchase a property with title number LA18196 (and a second small parcel MAN290105). On the map search these are showing as having a caution-  MAN215473 registered against them. Our solicitor asked for details weeks ago but hasn't heard anything and we are now very close to exchange. Can you let us know what is happening?

    That’s an application to register a new lease and submitted on 6th August. I assume there is a reason for the gap from completion to current submission but it’s unlikely to be considered for several months as now only a day old. Suggest clarifying with conveyancer and if it’s now urgent ask them to request expedition

    Details are available online or within days so unsure why something might take weeks as the registered information is available. 
    There are no information requests outstanding against those titles so hopefully the solicitor can clarify/confirm things

  • It hasn’t been expedited as I said, so might be worth him actually checking online - I’m assuming he checked for you? 
    One of us can’t be right and it reads as if he asked but hasn’t checked to confirm as IF it had been expedited he’d have been told when he asked 
    If it’s in order then it’s completed there and then. If it’s not expedited then the wait time is 9+ months from receipt 
    I’ll flag it with colleagues to see if we can expedite it but I’d encourage you to ask the conveyancer to check for themselves also

    However as I posted I’ve flagged it with colleagues so expedition should follow shortly 
    Thank you for your help with this. My solicitor has now received a requisition regarding a creditors notice that was added to the title register in 1995. I contacted the land charges office in June and was told that it had been removed from the land charges index under section 8 of the land charges act 1972. Can this notice now be removed from the title register and if so how do I get it removed?

    If it’s been removed then yes. The conveyancer needs to reply to our request dated 11th August and provide the evidence that it’s been discharged, dismissed or otherwise as appropriate 
    That's great, thank you. I have a letter from the land charges office that confirms it has been removed. I have already sent it to my conveyancer so will hopefully be sorted soon.

    Please could you advise if this has been seen yet?
