    Hi @Land_Registry we are having a lot of trouble with the solicitors in requesting a name to be added to a land registry. They said it was expedited on the 8th July, which I don’t think was the case on their behalf. Please could you advise, reference number is MG5D25B.

    That’s an application to register a shared ownership lease lodged on 10th August so I don’t think the quoted ref is the right one. Can you confirm please?

    Lodged 26 July so estimated timescale would mean it’s unlikely to be considered until end of Sept/early Oct. it’s not been expedited so would recommend they request that ASAP

    It hasn’t been expedited as I said, so might be worth him actually checking online - I’m assuming he checked for you? 
    One of us can’t be right and it reads as if he asked but hasn’t checked to confirm as IF it had been expedited he’d have been told when he asked 
    If it’s in order then it’s completed there and then. If it’s not expedited then the wait time is 9+ months from receipt 
    I’ll flag it with colleagues to see if we can expedite it but I’d encourage you to ask the conveyancer to check for themselves also

    However as I posted I’ve flagged it with colleagues so expedition should follow shortly 
    Thank you for your help with this. My solicitor has now received a requisition regarding a creditors notice that was added to the title register in 1995. I contacted the land charges office in June and was told that it had been removed from the land charges index under section 8 of the land charges act 1972. Can this notice now be removed from the title register and if so how do I get it removed?

    If it’s been removed then yes. The conveyancer needs to reply to our request dated 11th August and provide the evidence that it’s been discharged, dismissed or otherwise as appropriate

  • @Land_Registry yes the shared ownership property wasn’t registered when my seller first bought it. We are in the process of registering it in his name so that my solicitor can start the searches for my purchase of the property. The solicitor told us it had been expedited on the 8th July and had been approved!

    That's great, thank you. I have a letter from the land charges office that confirms it has been removed. I have already sent it to my conveyancer so will hopefully be sorted soon.

    Many thanks - that’s fine and makes sense then as the original application was cancelled and resubmitted hence the difference between current information I can see and what you had. 
    It’s expedited, processed but we needed more. Looks like they’ve replied yesterday so if that’s resolved things you should have a positive outcome shortly

    Stressed with selling our property and was wondering if anyone can help.

    Our buyer's solicitor has requested a copy of the lease plan with blue and yellow colouring, because our lease refers to a shared pathway and driveway coloured yellow and blue over which the property benefits from a right of way over.

    Our solicitor replied saying unfortunately, the plan does not contain any such colouring. However, the location of the shared pathway and driveway is abundantly clear from the Lease plan.



    They are now insisting that our solicitor approaches the landlord to obtain a complete copy and apply to the Land registry to update the filed copy held.

    Does anyone know how long this would take? We are already 14 weeks in and I was hoping to complete by the end of September.

    Responsibility for holding the lease and counterpart rests with the tenant and landlord respectively. If the copy we hold doesn’t have the colourings then it’s normal to ask the tenant/landlord to check what they (should) hold 
    it can and does happen so try not to stress too much as there are solutions 
    How long it takes depends on the landlord first but if they’ve got the original/a certified copy then they lodge that with us, we update the filed copy and presumably things move on for you 
    If the landlord doesn’t have it then the options are usually either an indemnity policy (check with conveyancer) which can be quick if they accept it or a new lease is drawn up which will delay things whilst that’s achieved
