  • We have just put our house on the market and on looking at the deeds and Land Registry title it appears that part of the fence between our garden and neighbouring field is very slightly outside the red line that depicts the boundary.  We have lived here for more than 40yrs and have never had any reason to believe that the fence was not in fact the actual boundary.
    We do not want to encounter any problems with a potential buyer ..how can we go about getting this sorted? Does it mean applying for adverse possession or can we ask for the title pan to be amended?

    We have purchased the property around 2 years, but we have not got Land registry. I have send Email and phoned the solicitor many times, however, this issue has not been sorted. I want to know who should I contact to sort out this problem apart the NBM solicitor.

    If it’s ‘very slightly outside the red line’ then it may not be an issue as the title plan will show the general boundaries 
    if you think it is an issue then I’d suggest speaking to your conveyancer re options and taking a look at our Practice Guides 40 supplements 3-5 inc and if you think Adv P is an option then PG 4 or 5 as appropriate

  • Hi LR, I hope you might be able to help and maybe give a bit of reassurance (Title Number- SGL387582)
    A number of leaseholders in a flat applied to have their leases extended back in February this year, as far as i was aware and according to the Solicitor everything was in order and went to plan.  I downloaded the Title Register yesterday, its still showing the original lease when I purchased the property (99 years from 11 August 1983), it states that this is correct as of the 19th May 2020.  Its showing nothing as Pending.
    Is there anyway i can check to see if the paperwork has been lodged correctly, I realise we are living in strange times, but this does seem particularly slow!

    The May date is when the oldest application was submitted against that title. We had delays prior to Covid and it’s impact delayed things further. 
    We won’t know if everything is in order until the application is considered but you’d expect the conveyancer to ensure it was at the time. 
    If there’s an urgency involved then speak to your conveyancer to see if things can be expedited. If there isn’t then please bear with us and it will be considered as soon as possible - that may be a while yet but that shouldn’t be something to worry about as the application and changes are protected whilst we have the application

    I need to assent my late father’s property to my mother and have noticed that the postcode on the Official copy of register of title is different to the actual property's postcode.  The last 2 letters on the register are DD but should be BB.  Is this going to cause problems?

    No - just draw attention to it when you apply

    Absolutely - for most property owners the registration part comes after everything else and the ‘rush’ is over 
    That’s not in anyway to suggest that we can take as long as we want to register it but in essence whether the wait is 1 hour, 1 day, 1 week, 1 month or even (hopefully not) 1 year has little or no impact on what happens next re your owning and living in the property. 
    But if it does become urgent then we can help. 
    So as you appreciate patience can be key where the wait is lengthy but you should be confident in the conveyancing and legal process and if so also that the registration will take place
