Hi again.
You kindly advised me to use form OC2 to get a copy of a charge noted on the file (as opposed to a registered charge). I sent the form off, and I got a response by post a week later. However, what I was sent was a copy of the form AN1 submitted by the solicitors, nothing else.
The form states "The applicant applies to enter an agreed notice protecting the following interest: An equitable charge dated [...] and made between [Mr A] and [the owner of the property]."
Ideally, I'd like a copy of that charge, although I'm not sure it was ever sent to the Land Registry. However, the AN1 states "the consent of the registered proprietor of the estate affected by the interest accompanies this application."
I'd like to see a copy of that consent, if possible. Is that just another OC2 form and another £7, or should I phone them up/email?
No reliance should be placed on the above! Absolutely none, do you hear?0 -

Most AN1 applications include the form and a copy of the document creating the interest. However if the registered owner’s consent is lodged then they don’t have to provide the document itself. As you state if you now want a copy of the consent then it’s another £7 and a second form OC2. The fee would still have been payable even if we’d known that both AN1 and Consent were lodged/available“Official Company Representative

Hi LR,
We are basically in a position to do a simultaneous exchange and complete tomorrow, except we are just waiting on the OS2 priority search to come back... How long do these priority searches usually take? The OS2 was applied for 13 May and still not heard back. My solicitor has chased.

Hi LR,
In 2015 my solicitor (now retired) updated my title deeds to make me sole proprietor but did not subsequently remove a restriction as follows: "RESTRICTION: No disposition by a sole proprietor of the registered estate (except a trust corporation) under which capital money arises is to be registered unless authorised by an order of the court".
I am now remortgaging the property and the case manager has advised that this needs to be corrected (removed) before that can proceed. Is it possible to combine the removal of this restriction and the remortgage updates in one request to the Land Registry? Or is there any other way to shorten the process time here, as the remortgage is in order to release equity for a new property purchase, so I am concerned about impacting that completion date.
Thanks,Pompo0 -

Thanks,PompoIf they do then great. If not then lodge the RX3 and supporting evidence and then submit a request to expedite to give it the best chance of being done ASAP, namely within 2 weeks if all in order“Official Company Representative

Thank you for the info regarding the time scales and process however.
If they do that then you are in the best possible place but will have to bear with the registration process. We will action each stage ASAP but the time between each stage is not always within our control so some patience will be required0 -

Hi Land Registry,My solicitor has just submitted a deed of variation to LR for registration - what are the expected timescales currently? Likewise, if we were to find a buyer and my solicitor was to submit a request to expedite on the grounds that it holds a transaction, what would these timelines be reduced to?Many thanks0
