  • I live next ro a farmhouse that the owners now rent out to large parties. They never mentioned it, found out on return from holiday. We share a driveway, but now the house is being rented we have so many more cars coming and going.(rented to groups of 10) as well as large groups of people walking up and down our driveway.they have to walk past out large dining room window. Do I have any “legal legs to stand on”?? I didn’t buy my barn only to have to share it loud hen parties, wedding guest groups and 8 loud couples in a hot tub!! Thank you for advice.

    Very much something to get legal advice on or you can try other posters on MSE if you provide the specific details re the registered right(s) re the access/shared drive for example.

    On the face of it it sounds more like something to discuss with the neighbours so they can ask anyone renting their property to be considerate for example when accessing, leaving or parking. But the devil is always in the detail and it may not be the registered details that are key here

    What sort of a leg do you want to stand on?

    The driveway - check the deeds to see what it says about the use (i.e. use for residential purposes only).

    Other considerations - Did they need/do they have the correct planning permissions to use the property in this way? The only people who can answer this will be the owners themselves or the local planning authority.

    Hi Land Registry,

    I was wondering if you could help. We are currently one year into the process of buying a house (our second mortgage offer is due to run out in 6 weeks).

    We are currently waiting on whether the seller will be granted adverse possession for some land in order for the sale to progress. Our understanding is that the seller's solicitor has now answered all of the requisitions which were raised and is currently waiting to hear back from yourselves. It has now been three weeks since the sellers solicitor answered the last requisition. The application has been expedited.

    We are struggling to get any further information about what is now going on with the application, what stage it is now up to and why it has now been three weeks since the sellers solicitor has heard anything from yourselves. The provisional title number is: CU313062.

    Is there any way you could shed any further light as to what is going on?

    There are a few stages to considering and completing an application based on adverse possession. Whilst not all of them may arise in my experience they generally do and each has to be reached and then passed before the next stage is actioned.

    The stages are
    Receipt/Wait
    Consideration - usually by a caseworker and lawyer
    Survey/Site visit - our 'eyes on the ground'
    Further consideration
    Wider checks - for example contacting adjoining or possibly affected landowners to see if they consent/object (with grounds to do so)
    Final (normally) consideration

    The requisitions you refer to can arise at any consideration stage.
    Expedition can be approved but that reduces the wait time between each stage. It does not for example reduce the timescale for the survey to be done or wider checks completed as we are reliant on third parties to complete these.

    Every case is unique so can throw up a variety of issues which have to be considered/resolved at each stage. The devil is always in the detail so timescales can and do vary as a result

    So which stage is this application at?

    Looking at the limited details I can access it has reached the Wider checks stage - those are unlikely to be completed before the 22nd/23rd May

    Hopefully, if everything is then in order it can be completed and the lodging solicitor notified.

    Nothing received against that title number as yet so I assume you have only just submitted it and it has yet to appear in our systems.

    If you submitted it last week then it may be worth checking to see whether the registration fee has been cleared by your bank.

    Once received the average wit time between receipt and consideration is 9 working days. Timescales after that can vary depending on whether it is in order and/ir whether wider checks are required
