    The seller has done neither. He was given all the information he asked for and based on that he diagnosed the problem, then blamed me for it, informed me that out of goodwill, he will contact the manufacturer. That was several days after I reported the problem stressing the seat was unsafe. The merchant has simply blamed me, rejected a cost effective solution and merely offered to contact the manufacturer.
    I'm not disputing any of that. I was correcting your misunderstanding of you believing you had a right to reject for a full refund. At this stage you don't.

    Thanks. My consumer law is very rusty indeed. I have hardly ever encounter problems like this as normally I deal with high street merchants. Lately though with mushrooming online activity, I have encountered several of such incidents. What I felt at the time I had to do was reject the idea that I was to blame. Since the merchant (having analysed the problem) concluded that I was to blame there was no point in going any further and he/she must not be allowed access to the goods for the possibility of tampering with it. All repair activity had to stop, not that any was proposed.

    If I may elaborate, I have only ever returned one item as it was missing fittings. (Ironically, it was a toilet seat!).Got an immediate refund and collection of item. I do have Amazon Prime and have several repeat orders which is useful and I don't want to lose these but I am prepared to risk this as one thing I don't like is a merchant who does not solve a problem, perhaps thinking the customer will go away and no doubt many do. Someone here would have gone away and paid 6 quid! It is true that we British do not like to complain. Well I lived and worked in the US and have embraced their complaints culture. You complain at the earliest opportunity. It is expected and it is what keeps businesses on their toes and motivates them to provide good service.

    You do realise that if this did go to a hearing, the merchant could request it be held in South Shields?

    Unless otherwise ordered by the court (and this is usually in exceptional circumstances) the consumer always gets choice of court - even if the consumer is the claimant.

    It's over 90 days so he won't be able to through his account. If he phoned Amazon customer services they might be kind enough to open one for him but they are not obliged to.

    It's £25, it's a grommet and a DIY repair and your going to go to Court! Unbelievable! Frivolous claim and may cost you!
