I havent yet but that is what I will do. Hope Amazon will sort it. I have only ever sent one item back. One thing I would like to be clarified is, what if it goes wrong and Amazon reject my request, presumably I could still initiate my action in court. I found Amazon to be very good with taking the consumers side on things. If this goes to court, dont you have a duty to mitigate losses, therefore a £6 thingy would have sorted it, so £6 you will be rewarded?“Quis custodiet ipsos custodes?”

Simply because any court claim will not be against Amazon.
Anyway, that aside, you told us on your other most recent thread than you didn't have time to progress that issue to court.
How on earth are you going to manage progressing two court cases at the same time?

It's over 90 days so he won't be able to through his account. If he phoned Amazon customer services they might be kind enough to open one for him but they are not obliged to.
If the OP is intent on court action, at least making attempts with Amazon will count as mediation.
IME Amazon will deal with claims regardless of time IF they are persuasive enough.0 -

1.The case against the credit card company and high street merchant will be started at the time of my choosing. I have 6 years and then accruing interest at 8 %.
2. The OPG paid up. What is outstanding is what to do about the papers they lost. They have offered to pay for costs incurred in obtaining replacement of same. I am considering employing the services of an accountant to obtain these from HMRC and forwarding the bill to the OPG. Hopefully the OPG will learn that carelessness costs money and improve their procedures so as not to mislay/destroy customers documents.....Illegitimi non carborundum
